86 <br /> <br />ORD~C~ /981-47 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, ANNEXING TO SAID CITY A CON- <br />TIGUOUS TRACT OF LAND CONTAINING 53.93 ACRES, <br />LOCATED WITHIN THE EXTRATERRITORIAL JURISDICTION <br />OF SAID CITY AND LYING ADJACENT TO PRESENT CITY <br />BOUNDARIES~' EXTENDING THE BOUNDARY LIMITS OF <br />SAID CITY SO AS TO INCLUDE SAID TRACT; GRANTING <br />TO THE INHABITANTS OF SAID TRACT ALL THE RIGHTS <br />AND PRIVILEGES OF OTHER CITIZENS OF THE ACTS AND <br />ORDINANCES, RULES AND REGULATIONS OF SAZD CITY <br />AND DECLARING AN EFFECTIVE DATE. <br /> <br /> WHEREAS, the City Council of the City of San Marcos, Texas, <br />provided an opportunity for all intereSted persons to be heard at a <br />public hearing on April 27, 1981, on the annexation by the City of <br />San Marcos, Texas of 53.93 acres of land adjoining the existing <br />city limits of said City in the Juan Martin Veramendi Survey Number <br />1, Hays County, Texas, and being described by metes and bounds as <br />follows: <br /> <br />BEGINNING at the South corner of the tract herein <br />described, said corner being in the Northwest right- <br />of-way line of Interstate Hwy. No. 35 and situated <br />N. 44 deg. 51' E. 3974.0 feet from a concrete monu- <br />ment at the intersection of said Northwest line and <br />the Northeast right-of-way line of McCarty Lane; <br /> <br />THENCE with the fenced common boundary of the land <br />herein described and the land Southwest of and adja- <br />cent thereto, N. 44 deg. 33' W. 1,448.3 feet to the <br />Southeast right-of-way line of the M.K.&T. RR.; <br /> <br />THENCE with said railroad right-of-way line, N. 47 deg. <br />55' E. 1,669.8 feet to the West corner of Thermon In- <br />dustrial Park; <br /> <br />THENCE with the Southwest line of Thermon Industrial <br />Park, plat of said park being recorded in Volume 1, <br />Page 121 of the Map Records of said County, S. 45 deg. <br />01' E. 1,359.0 feet to the Northwest right-of-way line <br />of Interstate Hwy. No. 35; <br /> <br />THENCE with said Northwest line, S. 44 deg. 51' W. 1,679.3 <br />feet to the PLACE OF BEGINNING, all corne~ of the tract <br />herein described being marked with iron stakes and con- <br />taining 53.93 acres of land. <br /> <br />The land herein described is that same land conveyed by W. <br />P. Donaldson, Jr. to Thermon Industrial Corporation, here- <br />inafter known as Indeco Corporation by Deed dated Septem- <br />ber 19, 1980 and recorded in Volume 347 at Page 629 of <br />the Deed Records of said County. Indeco Corporation has <br />sold 13.03 acres of the above-described land to Chisos <br />Investments (a partnership); and, <br /> <br /> WHEREAS, notice of said public hearing was publiShed in <br />the San Marcos Daily RecOrd, a newspaper having general circulation <br />in said city. and in the territory proposed to be annexed, on April <br />17, 1981, a date not more than twenty (20) days nor less than ten <br />(10) days prior to said hearing; and, <br /> <br /> WHEREAS, said 53.93 acres are located within the extrater- <br />ritorial jurisdiction of the City of San Marcos, Texas and not with- <br />in the extraterritorial jurisdiction of any other city; and, <br /> <br /> WHEREAS, said 53.93 acres are contiguous and adjacent to <br />the current boundaries of the City of San Marcos; now, therefore, <br /> <br /> <br />
