Drive; however, the City of San Marcos <br />shall have and retain the perpetual right to enter at any time <br />said 5005 square foot section of land for the sole purpose of <br />maintaining al I sewer and water I ines presently existing <br />thereunder. <br /> <br />2. That the City of San Marcos hereby relinquishes to the <br />said John M. Pool, et ux, all right, title and interest of the <br />City of San Marcos in and to said 5005 square foot section of <br />land, with the exception of said perpetual right here retained in <br />the City of San Marcos to enter same for the purposes of main- <br />taining al I sewer and water I ines presently existing thereunder, <br />such rei inquishment to be effective upon completion of said new <br />intersection of Sessom Drive with L.B.J. Drive. A copy of the <br />plans and specifications covering the construction of said <br />intersection is on file in the office of the City Engineer of the <br />City of San Ma~cos, and the said John M. Pool, et ux, are hereby <br />afforded access thereto at all reasonable times. <br /> <br />3. That the Mayor of the City of San Marcos is hereby <br />authorized, empowered and directed to execute and del iver to the, <br />said John M. Pool, et ux, a quitclaim deed to said 5005 square <br />foot section of land, such quitclaim deed to be executed and <br />delivered in the due and usual form by the Mayor and City Secretary, <br />in their respective capacities, and with the Seal of the City <br />of San Marcos and attestation of the City Secretary affixed and <br />shown thereon. Such execution and del ivery shal I be effected <br />upon the completion of said new intersection of Sessom Drive <br />and L,B.J. Drive. <br /> <br />Inasmuch as abandonment of this property is a necessary and <br />integral part in the imminent construction of the SessomDrive <br />project, therefore, an emergency exists, requiring that the <br />provisions of the Charter of the City of San Marcos, Texas, <br />which ordinari Iy require ordinances to be read on three (3) <br />several days and that no ordinance shal I become effective until <br />the expiration of ten (10) days following the date of its final <br />passage, be dispensed with.
