<br />/~7 <br /> <br />STATE OF TEXAS X <br />X <br />COUNTY OF HAYS X <br /> <br />THIS declaration of obligation is made by the City of San Marcos <br /> <br />.1 <br /> <br />a municipal corporation of the State of Texas; hereinafter called "City' , <br /> <br /> <br />in favor of John M. Pool of San Marcos, Texas, hereinafter called <br /> <br />"Pool", witnesseth: <br /> <br />WHEREAS, Pool has heretofore conveyed certain real property to <br />City for street purposes; and <br />WHEREAS, the City has agreed to quitclaim certain real property <br />to Pool, as shown in an ordinance of the City, a copy of which is here- <br />to attached and made a part hereof for all pertinent purposes; and <br />WHEREAS, there are still other phases of the overall agreement <br />between the City and Pool which should be set down in writing in order <br />to preserve their contents for the benefit of both parties; <br />NOW, THEREFORE, in consideration of the premises, the City does <br />irrevocably bind itself that, upon the lapse of a reasonable length of <br />time after the completion of the proposed intersection of Sessom Drive <br /> <br />~ <br /> <br />and L.B.J. Drive, as mentioned in said ordinance, the City, at its <br />expense, shall be obligated to Pool as follows: <br />(1) Extend curbing and gutter from said intersection to the <br />presently existing Forest Drive and L.B.J. Drive intersection. <br />(2) Extend a proposed box culvert approximately fifty (50) feet <br />to a point just downstream from the miniature golf course presently <br />existing upon the property of Pool. <br />(3) Place an inlet over said culvert' in order to receive the <br />water that will flow to said culvert. <br /> <br />IN WITNESS WHEREOF the City of San Marcos has authorized the <br /> <br />execution hereof by its Mayor and Secretary, as set out in a resolutio <br /> <br />. <br /> <br />of its City Council.
