<br />AN ORDINANCE CLOSING AND ABANDONING A PORTION OF
<br />PLEASANT STREET IN THE CITY OF SAN MARCOS, TEXAS,
<br />AND AN ALLEY NEXT TO THE H,A, NELSON FIRST ADDITION
<br />TO THE CITY OF SAN MARCOS, TEXAS; RELINQUISHING
<br />TO FRANCIS M. MAULDIN AND WIFE, MARTHA JANE MAULDIN,
<br />ALL RIGHT, TITLE AND INTEREST IN AND TO SUCK ABOVE
<br />MENTIONED PORTIONS; DIRECTING THE MAYOR OF THE
<br />CITY 01" SAN MARCOS TO EXECUTE AND DELIVER TO SAID
<br />PERSONS A QUITCLAIM DEED TO ABOVE SAID PORTIONS; AND
<br />DECLARING AN EMERGENCY,

<br />WH~REAS,a map br plat of H,A, N~lson's First Additinn to the
<br />City of San Marcos, Texas, is of't'ecord fn .Volu'me 89, page 244,
<br />Hays 'County Deed~Records, said map or pi at, and its record,
<br />being hereby refe~redto and made a part hereof for all legal,
<br />pertinent and descriptive purposes; and
<br />
<br />WHtREAS, said map or plat reflects the creation of the subdiv~sion
<br />known 'as H.A, Nelson's F,irst Addition; and
<br />
<br />WHEREAS, by instrument set fort'h in Volume 89, pages 222-223,
<br />the said H,A. Nelson, et ux., dedicated the streets shnwn on
<br />said plat to the use of the publ ic; and
<br />
<br />WHEREAS, by instrument set forth in Volume 156, pages 612-613,
<br />Deed Records of Hays County, Texas, a 20' wide strip of land was
<br />granted the City of San Marcos, Texas, for use asa publ ic street
<br />or alley; and

<br />WHEREAS, there is not indicated on said plat, nor in the above-
<br />mentioned instruments, nor anywhere else, any acceptance of
<br />jurisdiction by the County of Hays or the City of San Marcos,
<br />nor is either the Counfy of Hays or the City of San Marcos now
<br />exercising any jurisdiction over the hereinafter described
<br />portions of land, one of said portions being shown on said map
<br />or pI at; and
<br />
<br />WHEREAS, Francis M, Mauldin and wife, Martha Jane Mauldin, are
<br />the sole owners of the land adjoining such portions on the North
<br />and Northwest sides thereof; and
<br />
<br />WHEREAS, the said Francis M. Mauldin and wife, Martha Jane Mauldin,
<br />have petitioned the City of San Marcos to close and abandon said
<br />portions as d~scribed below, and have further petitioned said City
<br />to quitclaim to them all right, title and interest which said City
<br />may have: '

<br />NOW, THEREFORE, be it enacted and ordained by the City Council of
<br />the City of San Marcos, Texas:

<br />1. That the following portions of land be, and they are hereby
<br />abandoned, vacated, discontinued and ciosed as publ ic street, alley
<br />and right-of-way of the City of San Marcos:

<br />TRACT .ONE (1): A portion of Pleasant Street as ~hown On the plat
<br />of the H,A, Nelson's First Addition to the City of San M.rcos,
<br />Texas, duly recorded in Volume 89, page 224, of the Hays County
<br />Deed Records, said portion being more particularly described by
<br />metes and bounds as follows, to-wit:
