I I I THENCE with the northeast iine of Lots 126 and 124, same being the southwest right-of-way line of Cherry Street, S 450 21' E for 165.0 feet to the East corner of Lot 124; THENCE with the southeast line of Lot 124, same being the northwest line of a 16 foot wide alley, S 430 39' W for a distance of 142.5 feet to a point for the South corner of the herein described tract, same being the south corner of Lot 124; THENCE in a westerly direction, with the southwest line of Lots 124 and 126 for a distance of 165 feet to the West corner of Lot 126, same being the North corner of Lot 125 as located in the southeast right-of-way line of Live Oak Street; THENCE with the northwest line of Lot 126, same being the southeast line of Live Oak Street, N 430 39' E for 142.26 feet to the PLACE OF BEGINNING; CONTAINING within these metes and bounds approximately 24,000 square feet of lan~ area, more or less. SECTION 3. It is hereby determined that a bona fide offer has been'made on behalf of the City of San Marcos by its duly authorized representatives, and that the City and the property owners cannot agree as to the damages legally allowable by law. SECTION 4. The City of San Marcos through its attorneys is hereby directed and authorized to institute and prosecute to conclusion all necessary proceedings to condemn such property as is unable to be acquired through negotiation by reason of inability to agree with the OWners 'thereof as to the value of such property, or in order to obtain clear title thereto, or for any other legal action.
