1 1 I BEGINNING at the intersection of the Northeast line of a 16 foot wide alley with the Northwest right-of-way line of Walnut street, same being the South corner of Lot 39 of said Park Addition; THENCE with said alley line, N 450 35' W for 30 feet to a point for corner; THENCE N 430 25' E crossing Lots 39 and 40 for an approximate distance of 152 feet to a point for corner in the Northeast line of ~ot 40, same being the Southwest right-of-way line of Pecan Street; THENCE with said Pecan Street line, S 00 15' W for 43.85 feet to a'3/4 inch iron pipe marking the Southeast corner of Lot 40, same being at the intersection of Pecan Street wi th the Nprthwest right-of-way line of Walnut Street; THENCE with said"Walnut Street line, S 430 25' W for 120.44 feet to the PLACE OF BEGINNING; CONTAINING within these metes and bounds approximately 4,080 square feet of land area. SECTION 3. It is hereby determined that a bona fide offer has been made on behalf of the City of San Marcos by its duly authorized representatives, and that the city and the property owners cannot agree as to the damages legally allowable by law. SECTION 4. The City of S an Marcos through its attorneys is hereby directed and authorized to institute and prosecute to conclusion all necessary proceedings to condemn such property as is unable to be acquired through negotiation by reason of inability to agree with the owners thereof as to the value of such property, or in order to obtain clear title thereto, or for any other legal action.
