West, parallel to <br />and 160.00 .feet east of the said east right-of-way line <br />of Northcraft Street, a distance of 290.00 feet to the <br />PLACE OF BEGINNING and containing 1.3613 acres of land. <br /> <br />TO HAVE AND TO HOLD the above-described premises, together <br />with all and singular the rights and appurtenances thereto in <br />ari~qise belonging, unto the said Grantee, its successors and <br />assigns forever. . <br /> <br />This Deed is made and executed upon and is subject to certain <br />express conditions and convenants, said conditions and covenants <br />being a part of the consideration for the property hereby conveyed <br />and are to be taken and construed as running with the land and <br />upon the continued observance of which and each of which, 'with <br />t.l1e sole exception of covenants numbered FIRST and FIFTH, the con- <br />tinued existence of the estate hereby granted shall depend, and <br />the Grantee hereby binds itself and its successors, assigns, <br />grantees, and lessees forever to these covenants and conditions, <br />which covenants and conditions are as follows: <br /> <br />PI RST : <br />to public and <br />Renewal Plan, <br />upon the said <br />indicated: <br /> <br />The Grantee shall devote the property hereby conveyed <br />semi-public use only as defined in the approved Urban <br />and agrees to construct the following ~~provements <br />parcels for the estimated costs and by the dates <br /> <br />(1) Construction of a Municipal Police Courts Building <br />be completed by June 30, 1973 at an estimated cost of <br />$200,412.00, financing contingent in part upon a grant <br />from the Texas Criminal Justice Council. Said improve- <br />ments to be constructed upon disposition parcel lA-2. <br /> <br />(2) Construction of a swimming pool and park complex <br />to be completed by December 31, 1973, at an estimated <br />cost of $579,876.55 to be funded in part by a grant by <br />the Department of HUD. Said swimming pool and a portion <br />of the park complex to be constructed upon disposition <br />parcel ll-LB. <br /> <br />SECOND: The Grantee Shall pay real estate taxes or assess- <br />ments on the property hereby conveyed or any part thereof when due <br />and shall not place thereon any encumbrance or lien other than <br />for temporary and permanent financing of construction of the <br />Improvements on the property hereby conveyed as provided for in <br />the ~nd Amended Cooperation Agreement dated the 3iL day of <br />~~ ~ , 1972, between the parties hereto and as provided <br />h re~n, and for additional funds, if any, in an amount not to <br />exceed the consideration herein specified, and shall not suffer <br />any levy or attachment to be made or any other encumbrance or lien <br />to attach until the Grantor certifies that all building construc- <br />tion and other physical improvements specified to be done and <br />made by the Grantee have been completed; <br /> <br />THIRD: The Grantee shall commence promptly the construc- <br />tion of the aforesaid Improvements on the proPerty hereby conveyed <br />in accordance with the said Second Amended Cooperation Agreement <br /> <br />-3- <br />
