<br />AN ORDINANCE REGULATING AND SETTING RATES FOR
<br />ELECTRICAL UtILITIES; ESTABLISHING PROCEDURES
<br />AND REQUIREMENTS FOR RATE ADJUSTMENTS; PROVIDI~G
<br />FOR HEARINGS ON RATES AND SERVICES; REQUIRING
<br />REPORTS AND STATEMENTS; AND PROVIDING FOR A
<br />SA V I NGS CLAUSE.

<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />
<br />SECTION 1, That every electric util ity governed by this
<br />ordinance is hereby declared to be engaged in a business that is
<br />affected w.ith the publ ic interest and is subject to Jurisdiction,
<br />contro I and regu I at i on of the' City Counc i I in accordance with the
<br />provisions of the Constitution and laws of the State a~d ordinances
<br />of the City, and al I franchises and publ ic privileges as heretofor
<br />or hereafter granted by the City. The City Council assumes
<br />original regulatory jurisdiction in the fixing and the regulating
<br />of charges, fares or rates of any electric uti I ity now.enjoying
<br />or ,that may hereafter enjoy the pr i v i I ege of any franch i se, Of'
<br />exercising any other publ i~ privilege governed by this article,
<br />and any electric utility or person affected by the exercise of
<br />such jurisdiction,shal I have the right to appeai the~efrom to any
<br />court of competent jurisdiction.

<br />SECTION 2. That for the purpose of this ordinance the term
<br />"electric util ity" in';ludes any person, firm, corporation, special
<br />district, publ ic authority, publ ic cooperative or an{' other entity
<br />or his or its lessee, trustee, .receivers and agents, employees
<br />and servants now or hereafter owning or operat.ing in the City any
<br />wires, po I es, lines, condu it lines, p I ant property or equ i pment,
<br />while using a~y of the streets, al ley~ ~r publ ic grounds within
<br />the cOf'porate limits of the City fOf'the purpose of producing,
<br />generating, tr'ansmitting, conveying or. deliv~ringelectric power
<br />for the production of light, heat or power for'publ ic use, or for
<br />use of any person, firm or corporati~n within the City for compen-
<br />sation,
<br />
<br />The term "electric utj I ity" shall, for rate making purposes, include
<br />any entity as herein before defined producing, generating, trans-
<br />mitting, conveying or del ivering electric energy for the production
<br />of light, heat or power for public use, or for the yse of any
<br />consumer within the City for compensation.
<br />
<br />The term "rate" means ,~nd includes every compensation, charge, fare,
<br />to II, renta rand c I ass i f i cat i on or any of them dema~ded, charged,
<br />observed or corlected by any electric util ity for any service,
<br />product or commodity offered by it to the public, or to ~ny person,
<br />firm or corporation within the corporate I imits of the City, and
<br />rules, regulations, practices or contracts affecting any such
<br />compensation, charge, fee, toll, rental or classification.

<br />SECTION 3. That the fol lowing rate schedules for electrical rates
<br />within the corporate I imits of the City of San Marcos identified
<br />as Schedule A-3, Schedule B-IB, Schedule B-ic, Schedule B-3A,
<br />Schedule B-4 and Schedule 8-6, and more completely defined in
<br />"EXHIBIT A" as attached to, and made a part of, this ordina~ce is
<br />hereby in ful I force and effect until amended by ordinanc~
<br />approved by the City Cou~cil of the City of San Marcos, Texas.
<br />
<br />SECTION 4. That the City Council, for the purpose of determining,
<br />fixing and regulating the charges, fares, rates or ~ompensation,
<br />or for the purpose of prescribing maximum 'or minimum rates of. any
<br />e I ectr i c ut i I i ty now enjoy i ng, or that may hereafter. enjoy any
<br />franchise granted by the City, or exercise any other publ ic
<br />
<br />privilege within the corporate I imits of the City, or for the
<br />
