210E/7-14-~1 <br /> <br />k'RASCHIsE AGRE EMEN'.[' <br /> <br /> The parties to this Franchise Agreement are the City of San <br />Marcos, Texas, a municipal corporation duly incorporated as a <br />home rule city pursuant to the laws of the State of Texas, <br />acting through its Mayor as duly authorized by properly adopted <br />ordinance of the City Council of the City of San Marcos, and <br />the Lower Colorado River Authority, a body politic' and corpo- <br />rate and an agency of the State of Texas. The Lower Colorado <br />River Authority has provided electric power and energy to the <br />City of San Marcos and its residents for a number of years, <br />and, by the execution of this Franchise Agreement, the parties <br />evidence their agreement to the following terms and conditions <br />of this franchise for continued electric service by Lower <br />Colorado River Authority to the City ~o~ San Marcos and its <br />residents. <br /> <br /> I. <br /> <br /> The City of San Marcos hereby grants to the Lower Colorado <br />River Authority the right, power and authority to erect, <br />operate and maintain electric transmission and distribution <br />lines, towers, poles, mains, pipes, transformers, substations <br />and all other apparatus and appliances necessary or convenient <br />to the transmission or distribution of electric power and <br />energy, and to enter upon and to use the streets, alleys and <br />public grounds and ways of the City of San Marcos for such pur- <br />poses within the corporate limits of the City of San Marcos, as <br />those corporate limits now exist or as they may hereafter be <br />extended. The Lower Colorado River Authority's use of such <br />public streets, alleys, grounds and ways shall be consistent <br />with other 'public use of such facilities, and during construc- <br />tion the streets, alley, ways and grounds shall not be unneces- <br />sarily obstructed and shall within a reasonable length of time <br />be placed as nearly as practicable in as good condition and <br /> <br /> <br />
