210E/7-14-~1 k'RASCHIsE AGRE EMEN'.[' The parties to this Franchise Agreement are the City of San Marcos, Texas, a municipal corporation duly incorporated as a home rule city pursuant to the laws of the State of Texas, acting through its Mayor as duly authorized by properly adopted ordinance of the City Council of the City of San Marcos, and the Lower Colorado River Authority, a body politic' and corpo- rate and an agency of the State of Texas. The Lower Colorado River Authority has provided electric power and energy to the City of San Marcos and its residents for a number of years, and, by the execution of this Franchise Agreement, the parties evidence their agreement to the following terms and conditions of this franchise for continued electric service by Lower Colorado River Authority to the City ~o~ San Marcos and its residents. I. The City of San Marcos hereby grants to the Lower Colorado River Authority the right, power and authority to erect, operate and maintain electric transmission and distribution lines, towers, poles, mains, pipes, transformers, substations and all other apparatus and appliances necessary or convenient to the transmission or distribution of electric power and energy, and to enter upon and to use the streets, alleys and public grounds and ways of the City of San Marcos for such pur- poses within the corporate limits of the City of San Marcos, as those corporate limits now exist or as they may hereafter be extended. The Lower Colorado River Authority's use of such public streets, alleys, grounds and ways shall be consistent with other 'public use of such facilities, and during construc- tion the streets, alley, ways and grounds shall not be unneces- sarily obstructed and shall within a reasonable length of time be placed as nearly as practicable in as good condition and
