• ORDINANCE NO. 2008-26 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF <br />THE CITY BY REZONING PARTS OF LOTS 3 AND 4, ORIGINAL <br />TOWN OF SAN MARCOS FROM "CC" COMMUNITY <br />COMMERCIAL DISTRICT TO "CBA" CENTRAL BUSINESS AREA; <br />LOCATED AT 214 SAN ANTONIO STREET AND INCLUDING <br />PROCEDURAL PROVISIONS. <br />RECITALS: <br />1. On July 8, 2008, the Planning and Zoning Commission of the City of San Marcos held <br />a public hearing regarding a request to change the zoning from "CC" Community Commercial <br />District to "CBA" Central Business Area District, for Lots 3 and 4, Original Town of San <br />Marcos, located at 214 San Antonio Street. <br />2. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />considered and voted to approve the requests on July 8, 2008, and recommended that the <br />requests be approved by the City Council of the City. <br />is 3. The City Council held a public hearing on August 5, 2008 regarding the <br />requests. <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Official Zoning Map of the City, as described in Section 4.1.2.2 of the <br />City Land Development Code, is amended to rezone the following real property which is <br />presently zoned "CC" Community Commercial District to "CBA" Community Business Area <br />District: <br />Street addre 214 San Antonio Street. <br />Size- 0.2728 acres. <br />• Legal deseription, . A portion of Lots 3 and 4, Block 9, Original Town of San Marcos, a <br />metes and bounds description of which is attached as Exhibit A.
