ORDINANCE NO. 1981-57 <br /> <br />AN ORDINANCE OF THE CITY ODUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVlN~ THE PRICE A~D CONDITIONS OF <br />OF THE SAT.F. BY THE CITY OF SAN MARCOS, TEXAS, OF LOT <br />THIRTEEN (13) OF BLOCK NO. THIRTY-TWO (32) OF THE <br />SECOND SECTION OF VICTORY GARDENS ADDITION Il) SAID CITY, <br />IDCATSD IN HAYS COUNTY, TEXAS, TO DANIEL AGUILAR, JR.; <br />AUTHORIZING THE MAYOR PRO-TEMPORE TO EXSEUTE A ~dRRANTY <br />DESD TO DANIEL AGUILAR, JR.; A~D DECLARING AN EMEBGENCY. <br /> <br /> WHEREAS, the City of San Marcos, Texas, advertised for bids for the sale <br />of that certain real property known as Lot Thirteen (13) in Block No. Thirty- <br />Two (32) of the Second Section of Victory Gardens Addition to said City, lo- <br />cated in Hays County, Texas, also known as Urban Renewal Parcel No. 45R-21, <br />in the San Marcos Record, a local newspaper with a general circulation in the <br />County of Hays, State of Texas, on April 19, 1981 and April 26, 1981; and, <br /> <br /> WHEREAS, pursuant to said advertisement a bid was sukmitted by Daniel <br />Aguilar, Jr. for said described property in the amount of one thousand <br />dollars ($1,000.00); and, <br /> <br /> WHEREAS, the Urban Renewal Board of Con~nissioners of the City of San <br />Marcos, Texas, waived the minimum disposition price of $1,500.00 set for <br />said parcel because only one bid was received and that bid was from the <br />adjoining property owner; and, <br /> <br /> WHEREAS, said Board accepted the bid as the highest and best responsible <br />bid for said property on June 10, 1981; and, <br /> <br /> WHEREAS, said Board recoon~nends the approval of said purchase price and <br />the approval of the terms and conditions for said sale, as contained in the <br />bid document; now therefore, <br /> <br />BE IT ORDAINED BY THE CITY GOUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br /> SECTION: 1. That the terms and conditions of the sale by the City of <br />San Marcos, Texas, of Lot Thirteen (13) in Block No. Thirty-Two (32) of the <br />Second Section of Victory Gardens Addition to said City located in Hays <br />County, Texas, according to the map or plat thereof recorded in Volume 130, <br />Pages 48-52, Hays CountY Deed Records, also known as Urban Renewal Parcel No. <br />45R-21, to Daniel Aguilar, Jr. are hereby approved. <br /> <br /> SECTION 2. That the consideration of one thousand dollars ($1,000.00) <br />for said property be, and the same is hereby, approved. <br /> <br /> SECTION 3. That the purchaser is hereby placed on notice that the <br />subject property is subject to assessment under the provisions of Article <br />l105b, Texas Revised Civil Statutes. <br /> <br /> SECTION 4. That the mayor pro tempore of the City of San Marcos, Texas, <br />Berry R. James, be, and he is hereby, authorized to execute a warranty deed <br />to Daniel Aguilar, Jr. from the City of San Marcos, for said property. <br /> <br /> SECTION 5. That the importanoe of this Ordinance creates an emergency <br />and imperative purpose necessary that the provisions of the charter requiring <br />that ordinances shall be read on three separate meetings and that no <br />ordinance shall become effective until the expiration of ten (10) days <br />following the date of its final passage be suspended, and these provisions <br />are hereby suspended, and this Ordinance shall take effect and be in full <br />force and effect from and after its adoption and publication in a newspaper <br />of general circulation within the City. <br /> <br /> <br />
