Fe <br /> <br />damages or demands for damages to any person <br />or property by reason of the construction <br />and maintenance of its electrical lighting <br />and power system, or in any way growing out <br />of its privilege to use and occupy City streets, <br />alleys and public grounds, either directly or <br />indirectly, or by reason of any act, negligence, <br />or nonfeasance of the contractors, agents or <br />employees of Lower.~Colorado River Authority and <br />shall, by continuing to exercise its privilege, <br />indemnify and hold the City of San Marcos harm- <br />less from and on account of all damages, costs, <br />expenses, actions, and causes of action that <br />may accrue to or be brought by any person, per- <br />sons, corporation or corporations at any time <br />hereafter by reason of the exercise of said <br />privilege. <br /> <br />That Lower Colorado River Authority, its employees <br />and agents, shall comply in all respects with <br />requirements lawfully imposed by state and federal <br />law or by ordinance of the City Council of the <br />City of San Marcos. <br /> <br /> SECTION 5. That section 6 of Ordinance 1977-13 adopted March <br />28, 1977, is hereby amended to read as follows: <br /> <br /> Section 6. That if any section, subsection, sentence, <br />clause, phrase or portion of this ordinance is for any <br />reason held invalid or unconstitutional by any court of <br />competent jurisdiction, such portion shall be deemed a <br />separate, distinct and independent provision and such <br />holding shall not affect the validity of the remaining <br />portion hereof~. <br /> <br /> SECTION 6. That section 7 of Ordinance 1977-13, adopted <br />March 28, 1977, is hereby amended to read as follows: <br /> <br /> Section 7. Ail ordinances and parts of ordinances <br />in conflict with the provisions of this ordinance are <br />hereby repealed. <br /> <br /> SECTION 7. That this Ordinance shall take effect thirty <br />days after its final passage. <br /> <br />PASSED AND APPROVED on first reading July 27, 1981. <br /> <br />PASSED AND APPROVED on second reading August 10, 1981. <br /> <br />PASSED, ~PPROVED AND ADOPTED <br /> <br />Janis K.
