not now desire to do so, but rather desires to release and relinquish any <br />interest which it may have therein, save and except an easement ten feet (10') <br />in width adjacent to the west line of and extending the full depth of Tract <br />One for the purpose of ingress and egress by the City for any public purpose; <br />now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MA1RCOS, TEXAS: <br /> <br /> PART 1. That the City of San Marcos, Texas, quitclaim to Vico Real Estate <br />Company, Inc,, all its right, title and interest in and to the following <br />described two tracts of land: <br /> <br />TRACT I <br /> <br />BEGINNING at an iron stake set in a fence line on the south <br />west line of a lane sixteen (16) feet in width, and from which <br />iron stake another iron stake found at the most northerly <br />corner of a tract of land described as 3.78 acres in a deed <br />from James Tuttle to Mrs. E.C. Frisbie of record in Volume <br />217 at Page 212, Deed Records Hays County, Texas, bears S46° <br />00'E 54.82 feet; <br /> <br />THENCE with the southwest line of said lane sixteen (16) <br />feet in width, N46° 00'W 170.00 feet to an iron stake set in <br />the south right-of-way line of State Highway Loop 182; <br /> <br />THENCE with the south line of said Loop 182, N86° 34'E 21.71 <br />feet to an iron stake set in the northeast line of said lane <br />sixteen (16) feet in width; <br /> <br />THENCE with the Northeast line of said lane sixteen (16) feet <br />in width S46° 00'E 142.00 feet to an iron stake set;- <br /> <br />THENCE S4° 14'W 20.83 feet to the POINT OF BEGINNING. <br /> <br />TRACT 2. <br /> <br />BEGINNING at an iron stake set in the northeast fence line of <br />a lane sixteen (16) feet in width, and from which iron stake <br />another iron stake found at the most northerly corner of a <br />tract of land described as 3.78 acres in a deed from James <br />Tuttle to Mrs. E.C. Frisbie of record in Volume 217 at Page <br />212, Deed Records Hays County, TeXas, bears S4~ 14'W 20.83 <br />feet and S46~ 00'E 54.82 feet; <br /> <br />THENCE with the northeast line of said sixteen (16) feet in <br />width, N 46~ 00'W 142.00 feet to an iron stake set in the <br />south line of Texas State Highway Loop 182; <br /> <br />THENCE with the south line of said LOop 182, N86° 34'E 32.58 <br />feet to an iron stake set; <br /> <br />THENCE S46° 00'E 100.00 feet to an iron stake set; <br /> <br />THENCE S4~ 14'W 31.22 feet to the POINT OF BEGINNING. <br /> <br /> PART 2. That there be expressly excluded from said conveyance an easement <br />ten feet (10') in width adjacent to the west line of and extending the full <br />depth of Tract One, such easement being for the purpose of ingress and egress <br />by the City of San Marcos, Texas, in, on and across said ten foot strip of land <br />for any public purpose. <br /> <br />PART 3.
