190 <br /> FILED <br /> At o'clock to <br /> ORDINANCE ]-9 81-6 7 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, AMENDING APPENDIX <br />B, ENTITLED "AIRPORT ZONING REGULATIONS" OF <br />THE CODE OF ORDINANCES OF SAID CITY, TO ADOPT City of $~]_..M~FCO~ <br />A PLAT OF THE AIRPORT HAZARD AREA WHICH <br />ESTABLISHES PROHIBITED HEIGHTS FOR PROPERTY <br />ADJACENT TO THE SAN MARCOS MUNICIPAL AIRPORT <br />AS IT EXISTED IN NOVEMBER 30, 1954; TO <br />ESTABLISH THE SAN MARCOS CITY COUNCIL AS <br />THE BODY WITH THE POWER TO GRANT VARIANCES <br />FROM SAID ZONING REGULATIONS AND DECLARING <br />AN EMERGENCY. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br /> SECTION 1. That Section 3 of Appendix B, entitled "Airport Zoning Regulations," <br />of the Code of Ordinances of the City of San Marcos, Texas, is hereby <br />amended by attaching a plat of the Airport Hazard Area of the San Marcos <br />Municipal Airport as said Airport existed on November 30, 1954, said <br />Airport currently known as Lowman Airport, said plat to establish prohibited <br />heights for property adjacent to said Airport. Subsection (c) of Section <br />3 of Appendix B is hereby amended to read as follows: <br /> <br />Section 3. Plat of the airport hazard area. <br />.... c. San Marcos Municipal Airport- <br />Adopted August , 1981 <br /> <br /> SECTION 2. That Section 10 of Appendix B, entitled "Airport Zoning Regulations," <br />of the Code of Ordinances of the City of San Marcos, Texas, is hereby <br />amended to read as follows: <br /> <br />Section 10. Any person desiring to erect any structure <br />or installation, or increase the height of any structure <br />or installgtion, or permit the growth of any tree, or <br />otherwise use his property in violation to these reg- <br />ulations, may apply to the City Council of the City of <br />San Marcos, Texas, for a variance from the zoning <br />regulations in question. No Variance shall be allowed <br />in the approach zone to any runway now in existence or <br />any future runways as provided for in the plat of the <br />Airport Hazard Area for each of the airports as <br />specified herein, said plats attached hereto and made <br />a part thereof, said runways to be as same are defined by <br />Federal Aviation Administration criteria. Such variance <br />will be granted in other portions of the Airport Hazard <br />Area only if such variances will not cause a hazard to <br />airport users. Such variances as are provided for herein <br />shall be allowed where a literal application or enforce- <br />ment of the regulations would result in practical difficulty <br />or unnecessary hardship and the relief granted would not be <br />contrary to the public interest but do substantial <br />justice and be in accordance with the spirit of these <br />regulations and of the Airport Zoning Maps for each <br />of the airports specified herein, provided that any <br />variance may be allowed subject to any resonable conditions <br />that the City Council may deem necessary to effectuate <br />the purpose of these regulations. <br /> <br /> SECTION 3. That the importance of this ordinance creates an emergency <br />and an imperative purpose necessary that the provisions of the charter <br />requiring that ordinances shall be read at three separate meetings and <br />that no ordinance shall become effective until the expiration of ten (10) <br />days following the date of its final passage be suspended, and these <br />provisions are hereby suspended, and this Ordinance shall take effect and <br />be in full force and effect from and after its adoption and publication <br /> <br /> <br />
