• ORDINANCE NO. 2008-40 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE <br />CITY TO ESTABLISH A PLANNED DEVELOPMENT DISTRICT OVERLAY <br />FOR A 1.46 ACRE, MORE OR LESS, TRACT OF PROPERTY LOCATED AT <br />THE INTERSECTION OF CONCHO STREET AND LBJ STREET WITH <br />BASE ZONING OF "GC" GENERAL COMMERCIAL DISTRICT; <br />APPROVING A LAND USE PLAN AND DEVELOPMENT STANDARDS <br />FOR THE CONCHO COMMONS PDD; INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br />RECITALS: <br />1. On September 9, 2008, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to establish the zoning for a 1.46 acre, more or <br />less, tract of property located at the intersection of Concho and LBJ Streets as "PDD" Planned <br />Development District, with base zoning of "GC" General Commercial District to be known as <br />the Concho Commons Planned Development District. <br />2. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />did, on September 9, 2008, consider and vote to approve the request, and has recommended that <br />the request be approved by the City Council of the City. <br />3. The City Council held a public hearing on September 16, 2008, regarding the request. <br />• <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to zoning map amendments have been met. <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Official Zoning Map of the City, as described in Section 4.1.2.2 of the <br />City Land Development Code, is amended to amend the zoning for the following tract of real <br />property (collectively, the "Project Site"), which is currently zoned as "GC" General <br />Commercial District, as "PDD" Planned Development District, with base zoning as described <br />below for the respective tracts comprising the Project Site, subject to the provisions of the land <br />use plan and development standards described in Section 2 of this ordinance: <br />TRACT 1: BASE ZONING: "GC" GENERAL COMMERCIAL DISTRICT <br />0 Street address: Intersection of Concho and LBJ streets and bounded by Guadalupe Street.
