A. In addition to the acquisition of fee simple title to the 0.801-acre tract of property, the City of <br /> San Marcos is acquiring <br /> <br /> 1) a thirty foot (30') wide Temporary Construction Easement located adjacent and <br /> parallel to the Property for the purpose of constructing improvements within the <br /> Property, and <br /> <br /> 2) a sixty foot (60') by one-hundred foot (100') Temporary Construction Easement <br /> located adjacent to the Property and centered on the existing barn structure for the <br /> purpose of demolishing the existing barn structure. <br /> <br /> Copies of the Temporary Construction Easements are attached as Exhibit "C" and "D". <br /> <br />B. Within forty-five (45) days following the completion of the construction of the Project, <br /> Grantee shall repair any damage to the property or improvements thereon of Grantor in the <br /> Temporary Construction Easement which may have been damaged, displaced, removed or <br /> otherwise disturbed during the period of construction, to equal or better than existing <br /> condition, and shall fill all trenches, remove all rock, construction spoils and construction <br /> debris, replace all fencing, and restore the surface of the Temporary Construction Easement <br /> to its condition prior to commencement of such construction. All property of Grantor <br /> disturbed by construction of the Project in the Temporary Construction Easement shall be re- <br /> vegetated. <br /> <br />C. The Buyer will pay the escrow fee charged by the Title Company. <br /> <br />D. The Buyer will pay the cost of preparation of the general warranty deed, the Title Policy <br /> premium, Temporary Construction Easement, and the lien release(s), if any. <br /> <br />E. The Buyer will, as part of the Project, complete the following improvements: <br /> t) Salvage existing light posts and attempt to salvage light wiring, <br /> <br /> 2) Provide steps, if required, from the existing private sidewalk to the proposed <br /> hike/bike trail, <br /> <br /> 3) Protect water well during construction, <br /> <br /> 4) Construct approx. 6" concrete curb vault with access cover over existing water well, <br /> <br /> 5) Construct 20' concrete drive approach/apron approximately 20' from existing drive <br /> <br /> 6) Construct a roadway stub-out with barricade for future extension of Ramona Circle, <br /> <br /> 7) Install 1" water service and 4" wastewater service stub-out at approximately sta. <br /> 12+00 <br /> <br /> 8) Install 8" water service and 4" wastewater service stub-out at approximately sm. <br /> 14+00 <br /> <br />Page5 of 6 <br /> <br /> <br />
