<br />127. <br /> <br />RESOLUTION NO. 2004 - 77 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING EARNEST MONEY <br />CONTRACTS FOR RIGHT-OF-WAY ACQUISITIONS FOR THE <br />POST ROAD IMPROVEMENT PROJECT BETWEEN THE CITY <br />AND MOSSCLlFF, INC. FOR A 0.036 ACRE TRACT, AND <br />BETWEEN THE CITY AND RAY HARRIS AND NANCY HARRIS <br />FOR A 1.293 ACRE TRACT; RATIFYING THE CITY MANAGER'S <br />EXECUTION OF THE CONTRACTS; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. There is a public need for the acquisition of two tracts of real property, a 0.036 acre <br />tract of real property from Mosscliff, Inc. and a 1.293 acre tract from Ray Harris and Nancy <br />Harris, for the City's Post Road Improvement Project. <br /> <br />2. The City staff and right-of-way agents have negotiated the terms of the attached <br />earnest money contracts for the acquisition of these tracts, and the City Manager has executed <br />these contracts, and the City Council wishes to ratify these contracts. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. The attached Earnest Money Contract for the City's acquisition of a 0.036 acre <br />tract from Mosscliff, Inc. is approved. <br /> <br />PART 2. The attached Earnest Money Contract for the City's acquisition of a 1.293 acre <br />tract from Ray and Nancy Harris is approved. <br /> <br />PART 3. The execution of the attached contracts by the City Manager, Dan O'Leary, is <br />ratified and approved. <br /> <br />PART 4.
