ORDINANCE 2004- 30 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, REPEALING THE EXPIRATION OF <br />THE MUNICIPAL COURT TECHNOLOGY FEE; AND <br />INCLUDING PROCEDURAL PROVISIONS. <br /> <br /> RECITALS: ~: m <br /> <br /> 1. The City Council, in Ordinance 199%83, enacted City Code Sections 2.543 al~[ 2.544~ <br />establishing a Municipal Court Technology Fee, in accordance with Article 102.0172 of the <br />Texas Code of Criminal Procedure, to finance the purchase of technological enhancements for <br />the Municipal Court. <br /> <br /> 2. Under Section 2 of Ordinance 1999-83, the Municipal CCurt Technology Fee expires <br />on September 1, 2005, and in order to retain the fee, the City Council wishes to repeal this <br />expiration of the fee. <br /> <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br /> SECTION 1. "SECTION 2. Expiration and Administration of Fund" of Ordinance 1999- <br />83 is repealed, and City Code Sections 2.543 and 2.544, and the fee amount of $4.00 as set in <br />Section 3 of Ordinance 1999-83, are continued in effect. <br /> <br /> SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held <br />to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br /> <br /> SECTION 3. All ordinances and resolutions or pm'ts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br /> <br /> SECTION 4. The City Clerk will publish notice of adoption of this ordinance within 10 <br />days of the date of adoption.
