3. In requesting the use of an LCRA TSC mobile substation or temporary <br />equipment, the coordination procedures described in Exhibit 2 must be followed. <br />4. In order to best identify and provide the most appropriate mobile substation or <br />temporary equipment, LCRA TSC requires the User to provide the information <br />requested in Exhibit 3 at the time it makes its request for assistance. <br />5. Exhibit 4 will be used by the LCRA TSC to ensure that the equipment listed in <br />Exhibit 1 to be in good operating condition for the User. <br />6. If a request for the use of a mobile substation or temporary equipment is granted <br />by LCRA TSC, the compensation charges described in Exhibit 5 will apply. <br />7. Any User granted the use of an LCRA TSC mobile substation or temporary <br />equipment will be employing equipment which is normally in service with the <br />LCRA TSC. This equipment is not new and was neither designed nor <br />manufactured by the LCRA TSC. The User is responsible for protecting its <br />employees and third party contractors, if any, as well as any system equipment <br />by providing the proper safety equipment, devices, training and instructions for <br />any particular use, and to take the necessary steps to conform to all applicable <br />Federal, State and Local safety standards including OSHA and the IEEE <br />guidelines. <br />8. This MOU covers only the loan of mobile substations and temporary equipment <br />and does not address delivery, setup or any professional or labor assistance to <br />the User. LCRA TSC has no employees of its own, and any professional or labor <br />assistance needed to utilize a mobile substation will be provided through a <br />separate agreement with the Lower Colorado River Authority's Transmission <br />Services Business Unit. <br />9. LCRA TSC will acquire insurance for the mobile substation, temporary <br />equipment, and all related equipment for the defined usage period whenever this <br />equipment is loaned to a User. This insurance will only cover the replacement <br />costs of the LCRA TSC owned equipment. LCRA TSC will pay the deductible in <br />the event any of its equipment is damaged or destroyed. The User will not be <br />held accountable for the replacement cost of the equipment, unless the damage <br />or destruction is due to negligence. Daily insurance costs will be part of the daily <br />fee paid by the User. <br />10. The User agrees to use the mobile substation or temporary equipment only for <br />the purpose and in the manner for which it was intended by the manufacture. <br />LCRA TSC expects that any mobile substation or temporary equipment loaned to <br />a User pursuant to this MOU will be returned to LCRA TSC in its original, <br />functional condition, ordinary wear and tear excepted. The User agrees not to <br />remove, deface, or obscure ownership labels to the mobile substation, temporary <br />equipment, or any support equipment. <br />Mobile - Memorandum of Understanding 4/28/2010 Page 2 of 11 <br />
