(2) provide for commercial general liability insurance coverage, for <br />claims for property damage or bodily injury, including products and <br />completed operations; and <br /> <br />(3) be in a coverage amount of not less than $300,000 for all claims <br />arising in any one year period. <br /> <br />(c) This article and article 12 of this chapter do not after the responsibility <br />of any person performing any construction activity for damages to anyone <br />or for performance of a contract. Neither the city nor any city officer or <br />employee assumes any liability on the basis of an inspection activity or a <br />license, certificate or permit issued pursuant to this article or Article 12. <br /> <br />(d) A person who meets all other requirements for licensing as a building <br />contractor is exempt from this insurance requirement provided: <br /> <br /> (1) the person submits with the license application a statement <br />under oath that the person is applying for a permit to construct a single <br />family residence on property owned by the person, and the residence will <br />be occupied as the person's homestead; <br /> <br /> (2) the license issued to the person will be limited to the obtaining <br />of a building permit to construct one single family residence on the <br />property owned by the person; and <br /> <br /> (3) the person has not been issued a building permit within the past <br />five years. <br /> <br /> SECTION 3. Section 14.377(a) of the San Marcos City Cede is <br />amended as follows (underliningi indicates added text, strikethrouqh <br />indicates deleted text): <br /> <br />Sec. 14.377. Issuance, renewal of license. <br /> <br />(a) Upon receiving a completed application form, any required proof <br />of passing a licensing test, and a current insurance certificate <br />meeting the requirements of Section !4.009 14.375 (if applicable), <br />the building official will issue a license to the applicant. <br /> <br /> SECTION 4. If any word, phrase, clause, sentence, or paragraph of <br />this ordinance is held to be unconstitutional or invalid by a court of <br />competent jurisdiction, the other provisions of this ordinance will continue <br />in force if they can be given effect without the invalid portion. <br /> <br /> <br />
