Ne one did, se Mayor Narvaiz closed the public hearing. <br /> <br />Mayor Narvaiz introduced a public hearing regarding an Annexation <br />Ordinance, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 107.759 ACRES, MORE <br />OR LESS, LOCATED IN THE 2600 - 3000 BLOCKS OF OLD BASTROP HIGHWAY <br /> (HIGH SCHOOL TRACT); AND INCLUDING PROCEDURAL PROVISIONS. <br /> <br />Mayor Narvaiz opened the public hearing and asked if anyone wished te <br />speak. 1) Mary E. Gonzales stated she lives on Old Bastrop Highway. She <br />also stated she is a member of the neighborhood association and they have <br />a petition started. She stated 90% of this area is against this <br />annexation because ef the location for the proposed High School. Mayer <br />Narvaiz asked if anyone else wished te speak. No eno did, se Mayer <br />Narvaiz closed the public hearing. <br /> <br />Hayer Narvaiz introduced a discussion regarding the update en Wonder World <br />Overpass Project. Sabas Avila, Assistant Director ef Engineering <br />Department, stated TxDOT was te let the project in May the accommodate the <br />purchase of right-of-way with September beginning the project. He stated <br />the TxDOT Design Division Office did net include eno-way frontage roads. <br />He stated the design needs to be modified te one-way frontage roads and <br />two crossings at the overpass. He stated the biggest obstacle is waiting <br />for Union Pacific approval of the agreement with TxDOT. He stated the <br />Edwards Aquifer update the project in March and is fairly complete. He <br />stated TxDOT's condemnation proceeding en Carson's two tracts awarded $2.4 <br />million for eno tract and $400,000.00 for the ether tract. TxDOT was <br />offering for beth tracts approximately $600,000.00. He stated TxDOT is <br />appealing the award and asking fur a jury trial. The City held <br />condemnation proceedings on the City's portion ef the Carson's two tracts. <br />He stated the City appraisal was $175,000.00 and the Commissioners awarded <br />$215,000.00. He stated the City will need to come up with an additional <br />$40,000.00. Mr. Themaides inquired who with the City is negotiating with <br />Union Pacific. Mr. Sabas stated the negotiations are strictly between <br />TxDOT and Union Pacific. Mr. Thomaides stated he feels someone should <br />contact Union Pacific to let them know the importance ef this project. <br />Mayer Narvaiz stated a discussion item should be agendized at the next <br />Regular Council Meeting on June 28, 2004, regarding Union Pacific blocking <br />Wonder World Drive. <br /> <br />Mayer Narvaiz introduced an Executive Session pursuant to the Government <br />Cede, Section 551.071, to seek the City Attorney's advice regarding <br />pending litigation, contemplated litigation, a settlement offer, er a <br /> <br /> <br />
