RESOLUTION 2010 - 102R <br />• A RESOLUTION OF, THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, RATIFYING THE FILING OF A GRANT <br />APPLICATION WITH THE CAPITAL AREA COUNCIL OF <br />GOVERNMENTS FOR A FY2010 /2011 REGIONAL SOLID WASTE <br />HOUSEHOLD HAZARDOUS WASTE PROGRAM GRANT; PLEDGING <br />THAT IF THE CITY RECEIVES A GRANT AWARD IT WILL COMPLY <br />WITH THE GRANT REQUIREMENTS OF CAPCOG, THE TEXAS <br />COMMISSION ON ENVIRONMENTAL QUALITY AND THE STATE OF <br />TEXAS; AUTHORIZING THE ACTING CITY MANAGER TO ACT ON <br />BEHALF OF THE CITY IN ALL MATTERS RELATED TO THE GRANT <br />APPLICATION AND ANY SUBSEQUENT GRANT AGREEMENT AND <br />DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. The Capital Area Council of Governments ( "CAPCOG ") is directed by the Texas <br />Commission on Environmental Quality ( "TCEQ ") to administer solid waste grant funds for the <br />implementation of CAPCOG's adopted regional solid waste management plan. <br />2. The City is qualified to apply for grant funds under the Request for Applications <br />• process. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The filing of a grant application with CAPCOG in the amount of <br />$22,600.00 for FY 2010/2011 Regional Solid Waste Grants Program for the household <br />hazardous waste disposal program funding is approved. <br />PART 2. The Acting City Manager is authorized to request grant funding under the <br />CAPCOG Request for Applications of the Regional Solid Waste Grants Program for the <br />household hazardous waste disposal program and act on behalf of the City in all matters related <br />to the grant application and any subsequent grant contract and grant project that may result. <br />PART 3. If the project is funded, the City will comply with the grant requirements <br />of CAPCOG, TCEQ, and the State of Texas. <br />PART 4. The grant funds and any grant- funded equipment will be used only for the <br />purposes for which they are intended under the grant. <br />PART 5. The City's activities regarding any project resulting from this application <br />will comply with and support the adopted regional and local household hazardous waste <br />• management plans adopted for the geographical area in which the activities are performed. <br />1 <br />
