• <br />ORDINANCE NO. 2008 -46 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING THE ABANDONMENT OF MEINERS <br />STREET BETWEEN THORPE LANE AND AQUARENA SPRINGS DRIVE; <br />APPROVING THE CONVEYANCE OF THE RIGHT OF WAY TO <br />AQUARENA PLAZA, LLC AND WAYLAND AND CHARLOTTE ENDSLEY; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED; AND <br />DECLARING AN EMERGENCY. <br />RECITALS: <br />1. On June 10, 2008, the City Planning and Zoning Commission conducted a public <br />hearing on the proposed abandonment of Meiners Street between Thorpe Lane and Aquarena <br />Springs Drive, and voted unanimously to approve the proposal subject to the granting of <br />easements to the existing utilities at the time of closing on the property. <br />2. The owners of the real property abutting Meiners Street between Thorpe Lane and <br />Aquarena Springs Drive, have requested and consented to this abandonment. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The abandonment of Meiners Street between Thorpe Lane and Aquarena <br />Springs Drive, as shown on the attached Exhibit "A," is approved. <br />SECTION 2. The City Manager, Rick Menchaca, is authorized to execute the deed <br />attached to this Ordinance conveying Meiners Street between Thorpe Lane and Aquarena <br />Springs Drive to Aquarenea Plaza, LLC and Wayland and Charlotte Endsley. <br />SECTION 3. The importance of this Ordinance creates an emergency and an <br />imperative public necessity, and the provisions of the Charter requiring that ordinances be <br />presented at three separate meetings, and that ordinances do not take effect until ten days after <br />the date of its final passage are suspended, and this Ordinance will take effect at 12:00 a.m. on <br />the day following the date of publication of notice of its adoption in a newspaper of general <br />circulation within the City. <br />Read, considered and adopted on the 6th day of October 2008. <br />Susan Narvaiz <br />Mayor
