the City of San Marcos and conducting a solicitation and operating program to attract visitors and <br />conventions to the City. <br />B. The Chamber shall make these expenditures in conformance with and in proportion to the <br />Convention and Visitor Bureau budget for 2008-2009 which is marked Exhibit "A" and attached to <br />this Contract for all intents and purposes as though fully set out herein. The Chamber Board, on <br />recommendation of the CVB Advisory Board, may approve amendments to the budget to transfer <br />funds among line items. The Chamber acknowledges that the City's approval of this budget, and the <br />CVB Advisory Board's recommendation of amendments to the budget, create a fiduciary duty in the <br />Chamber with respect to the CVB Funds provided by the City to the Chamber under this Contract. <br />All expenditures of CVB Funds shall be subject to monitoring by the CVB Advisory Board under <br />Section 4.C. below. <br />C. The Chamber shall submit to the City Clerk, in electronic format, a report on or before the <br />following deadlines, with a copy to the City Manager and the City Finance Manager, describing the <br />activities and expenditures resulting from previously allocated CVB Funds during the respective <br />reporting period: <br />Report Submission Deadline Period Covered <br />March 15, 2009 October 1, 2008 through December 31, 2008 <br />June 15, 2009 January 1, 2009 through March 31, 2009 <br />September 15, 2009 Aril 1, 2009 through June 30, 2009 <br />December 15, 2009 July 1 through September 30, 2009 <br />D. Should the CVB, or the Chamber, sponsor a community or arts event, funding such event <br />with funds designated under this contract, the Chamber shall submit a completed Post Event Report <br />in a form approved by the City Manager. <br />3. OPERATION AND MAINTENANCE OF TOURIST INFORMATION CENTER <br />A. Facility Description. The Tourist Information Center (the "Tourist Center") is owned by <br />the City and is located at 617 IH-35 North in San Marcos, Texas. <br />B. Operation of Center. The Chamber agrees to use CVB Funds for the operation and <br />maintenance of the Tourist Center in accordance with the following: <br />1.
