17. Public Hearing to receive comments for and against an ordinance amending the <br />San Marcos Citv Code, Subpart B, Land Development Code, Chapter 1, Article 2 <br />Division 1, Section 1.2.1.3(e) and amendine Chapter 1 Article 4 by adding a new <br />Division 4, Sections 1.4.4.1 through 1.4.4.4, to provide for waiver or modification of <br />development standards by the San Marcos City Council as an economic <br />development incentive; including procedural provisions, and consider ordinance on <br />first of three readings. <br />Mayor Narvaiz opened the Public Hearing at 9:59 p.m. <br />Tyler Carlson, San Marcos, supports this item if it will make the process more open. <br />However, it should be noted that some things just can't be granted, especially if they are <br />so far off from the code or a health and safety issue. He would like to see some structure <br />as to when a variance can be granted. <br />There being no further public comments, Mayor Narvaiz closed the Public Hearing at <br />10:01 P.M. <br />MOTION: Upon a motion made by Councilmember Jones and a second by <br />Councilmember Couch, the City Council voted six (6) for and none (0) opposed, to <br />approve the ordinance, as previously captioned, on the first of three readings. The <br />motion carried unanimously. <br />18. Consider adoption of Ordinance 2008-33, amending Chapter 86, Utilities, Article <br />5, Fees, Charees and Billing Procedures, Section 86.198 of the San Marcos Citv <br />Code to create an electric transformer recovery fee for new or upgraded electric <br />service; including procedural provisions and declarine an emergency. <br />MOTION: Upon a motion made by Councilmember Thomaides and a second by <br />Councilmember Guerrero, the City Council voted seven (7) for and none (0) opposed, to <br />approve Ordinance 2008-33, as previously captioned, on emergency. The motion carried <br />unanimously. <br />19. Consider adoption on third and final reading of Ordinance 2008-34 increasing <br />water and wastewater rates established under sections 86.231 and 86.262 of the City <br />Code; increasing surcharee rates for industrial wastewater discharees under section <br />86.132 of the City Code; setting rates for wholesale water treatment, wholesale <br />water sales and reclaimed water sales. <br />MOTION: Upon a motion made by Mayor Narvaiz and a second by Councilmember <br />Couch, the City Council voted five (5) for and one (1) opposed, with Councilmember <br />Thomaides voting against, to table this item to allow staff to study this plan for our future <br />water needs, and to fund this year's budget request with $1,069,000 from our reserve <br />fund.
