<br />RESOLUTION NO. 2004-.130- R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS EXPRESSING THE CITY'S SUPPORT FOR <br />AMENDMENTS TO FEDERAL STATUTES AND REGULATIONS <br />TO PROVIDE FOR LIMITATIONS ON THE LENGTH OF TIME A <br />TRAIN MAY BLOCK A STREET WHILE STATIONARY, AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City Council of the City of San Marcos wishes to express its concern for the <br />safety and welfare of its citizens; and <br /> <br />WHEREAS, currently local authorities such as the City Council are preempted by various federal <br />statutes, regulations and federal court holdings from regulating the length of time a train may block a street <br />while stationary; and <br /> <br />WHEREAS, railroad tracks bisect the City of San Marcos including the road that constitutes the <br />most direct route to the only hospital in San Marcos thereby cutting off access to the hospital to the <br />majority of the population of the City; and <br /> <br />WHEREAS, the City Council believes that this situation endangers the safety of its citizens, and <br />the City Council wishes to express support for changes to federal statutes and regulations to provide for <br />limitations on the length oftime a train may block a street while stationary; now, therefore <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. The City of San Marcos supports changes to federal statutes and regulations to provide <br />for limitations on the length of time a train may block a street while stationary, either in the federal statutes <br />and regulations themselves (and allowing for effective local enforcement), or by removing the preemption <br />of local governmental authorities to regulate the matter. <br /> <br />PART 2. The Mayor of the City of San Marcos is authorized and directed to transmit copies of this <br />resolution to the City's representatives in the United States House of Representatives and Senate, and to the <br />Chair of the federal Surface Transportation Board. <br /> <br />PART 3.
