ORDINANCE NO. 2010-35 <br />• AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, ANNEXING TO THE CITY AN AREA CONSISTING <br />OF 10.4391 ACRES OF LAND, MORE OR LESS, OUT OF THE JOHN <br />WILLIAMS SURVEY, ABSTRACT NOS. 471 AND 490, AND THE <br />THOMAS JEFFERSON CHAMBERS SURVEY, ABSTRACT NO. 2, SUCH <br />AREA BEING KNOWN AS THE WONDER WORLD DRIVE <br />EXTENSION THAT EXTENDS WEST APPROXIMATELY 0.8 MILES <br />FROM THE INTERSECTION OF WONDER WORLD DRIVE AND <br />CRADDOCK AVENUE; APPROVING A SERVICE PLAN FOR THIS <br />AREA; INCLUDING PROCEDURAL PROVISIONS; DECLARING AN <br />EMERGENCY; AND PROVIDING AN EFFECTIVE DATE. <br />RECITALS: <br />1. The City Council of the City of San Marcos, Texas, provided an opportunity for <br />all interested persons to be heard at a public hearing, held on July 20, 2010, to consider the <br />proposed annexation by the City of 10.4391 acres of land, more or less, known as the Wonder <br />World Drive Extension that extends west approximately 0.8 miles from the intersection of <br />Wonder World Drive and Craddock Avenue in Hays County, Texas (the "Annexation Area "), <br />such Annexation Area consisting of the following tracts as further described by metes and <br />bounds in the attached Exhibit "A ": <br />• a) a 4.82 acre, more or less, tract of land out of the John Williams Survey, <br />Abstract No. 490 and the Thomas Jefferson Chambers Survey, Abstract No. 2; <br />b) a 0.345 acre, more or less, tract of land out of the John Williams Survey, <br />Abstract No. 471; and <br />C) a 5.2741 acre, more or less, tract of land out of the John Williams Survey, <br />Abstract No. 471 and the Thomas Jefferson Chambers Survey, Abstract No. 2 <br />2. A petition was filed by the owner(s) of said Annexation Area more than five days <br />and less than 30 days before the city council heard the petition and the arguments for and against <br />the annexation. <br />3. Public notice of said hearing was published in a newspaper of general circulation <br />before the 15 day before said hearing at which the city council heard such petition. <br />4. The Annexation Area has no permanent residents, consists of a small piece of <br />land that is less than one -half mile in width, and the other requirements of Section 43.028 of the <br />Texas Local Government Code have been met. <br />• 5. The proposed service plan was made available at the public hearing. <br />
