On June 22, 2004, the Planning and Zoning Commission of the City of San Marcos <br />held a public hearing regarding a request to establish the zoning as "C" Commercial District for a <br />117.834 acre tract of property located in the 2700 and 2800 Blocks of Interstate Highway 35. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />did, on June 22, 2004, consider and vote to approve the request, and has recommended that the <br />request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the 2nd day of August <br />2004, regarding the request. <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to <br />zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of <br />the San Marcos City Code, is amended to establish the zoning for the following real property as <br />"C" Commercial District: <br /> <br />Street address: 2700 and 2800 Blocks of Interstate Highway 35. <br /> <br />Size: 117.834 acres. <br /> <br />Legal description: See the metes and bounds description attached as Exhibit A. <br /> <br />Deed or plat reference: Volume 1514, Page 785, Hays County Deed Records. <br /> <br />SECTION 2. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City <br />
