• ORDINANCE NO. 2008-48 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE SAN MARCOS <br />HORIZONS CITY MASTER PLAN ADOPTED IN SECTION <br />1.4.1.1 OF THE CITY LAND DEVELOPMENT CODE BY <br />ADOPTING A NEW APPENDIX ENTITLED "DOWNTOWN <br />MASTER PLAN"; AND INCLUDING PROCEDURAL <br />PROVISIONS. <br />RECITALS: <br />1. Section 1.4.1.1 of the City Land Development Code adopts the San Marcos Horizons City <br />Master Plan as the master plan for the physical development of the City. <br />2. Beginning in March 2007, the staff have overseen the preparation of a new appendix to <br />the master plan entitled "Downtown Master Plan". The process included a number of public <br />meetings, culminating August 5, 2008, in a City Council - Planning and Zoning Commission joint <br />workshop <br />3. After the workshop, the Planning and Zoning Commission conducted a public hearing on <br />this appendix on September 9, 2008, and voted to recommend the adoption of the Downtown Master <br />Plan to be added as a new appendix to the San Marcos Horizons City Master Plan by the City <br />Council. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br />SECTION 1. The San Marcos Horizons City Master Plan adopted in Section 1.4.1.1 of the <br />City Land Development Code is amended by the adoption and addition of an appendix entitled <br />"Downtown Master Plan" in the form attached to this ordinance. <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to <br />be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br />SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in conflict <br />with this ordinance are repealed. <br />SECTION 4. This Ordinance will take effect 10 days after the date of its final passage, and <br />the City Secretary will publish notice of its adoption in a newspaper of general circulation in the <br />city. <br />• PASSED AND APPROVED on first reading September 16, 2008
