<br />RESOLUTION 2008- 77 R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING A CONTRACT WITH FEDERAL SIGNAL <br />CORPORATION AND BLUE MOON SOLUTIONS, INC. FOR THE <br />PURCHASE AND OPERATION OF A CITY-WIDE WIRELESS MESH <br />NETWORK; APPROVING AN AGREEMENT WITH SUN TRUST <br />EQUIPMENT FINANCE AND LEASING CORPORATION FOR FINANCING <br />THE WIRELESS MESH NETWORK; AUTHORIZING THE CITY MANAGER <br />TO EXECUTE THE AGREEMENTS ON BEHALF OF THE CITY AND <br />DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. The City issued a request for proposals seeking to provide the hardware, software, and <br />to present an alternative business plan for the operation of a City-Wide Wireless Mesh Network. <br />Proposals submitted in response to the RFP were received on September 30, 2007. <br />2. Based on an evaluation utilizing the evaluation factors and selection criteria and <br />. following the review and selection process utilizing an alternative business method as identified <br />in the RFP, the City selected the proposal submitted by Federal Signal Corporation, which <br />included Blue Moon as a subcontractor and provider of management and marketing services, as <br />the most advantageous proposal received in response to the City's RFP with respect to design, <br />installation, commissioning and operating the City Network and serving as a marketing agent for <br />the City Network as a potential revenue generating source. <br />3. After extensive negotiations, the City reached an agreement with Federal Signal for <br />the purchase and installation of a city-wide wireless mesh network. The City negotiated a <br />separate contract with Blue Moon Solutions to partner with the City in the operation of the <br />wireless mesh network. <br />4. The City initially sought to enter into a lease purchase agreement with Federal Signal <br />for the purchase of the wireless mesh network. Due to changes in the market, as well as certain <br />contractual issues, staff bid the financing of the network purchase. Sun Trust Equipment Finance <br />and Leasing Corporation provided the most favorable response to the City's bid requests. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The attached contract with Federal Signal Corporation for the purchase and <br />. installation of a City-Wide Wireless Mesh Network for the sum of $3,211,747.00 is approved.
