'~O <br />c::;) <br />~~ c::;) P- <br />o .þ <br />0 3: <br />ø <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. Pursuant to Sections 82.003 and 82.066 of the City Code, on the basis <br />of an engineering and traffic investigation, the traffic register maintained under Section <br />82.067 of the City Code is amended by adding the following speed limit: <br /> <br />Clovis Barker Road from IH 35 east access road to SH 123, both directions, 45 <br />m.p.h. <br /> <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance <br />is held to be unconstitutional or invalid by a court of competent jurisdiction, the other <br />provisions of this ordinance will continue in force if they can be given effect without the <br />invalid portion. <br /> <br />SECTION 3. All ordinances and resolutions or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br /> <br />SECTION 4. Any person violating any provIsion of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code. <br /> <br />SECTION 5. This ordinance shall be in effect ten days from and after its passage, <br />and the City Clerk will publish notice of its adoption in a newspaper of general circulation in <br />the City. <br /> <br />PASSED AND APPROVED on first reading July 26, 2004. <br /> <br />PASSED AND APPROVED on second reading August 9, 2004. <br /> <br />PASSED, APPROVED AND ADOPTED August 23, 2004. <br /> <br />~~ . <br /> <br />Susan NarvairQ <br />Mayor <br />
