<br />209. <br /> <br />RESOLUTION NO. 2004 - 140 R <br />-.- <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING A LICENSE AGREEMENT <br />BETWEEN THE CITY AND G.A. HERMES AND MARY E. HERMES <br />FOR THE USE OF A PORTION OF AN ALLEY BEHIND THE <br />PROPERTY AT 129 E. HOPKINS STREET; AUTHORIZING THE <br />CITY MANAGER TO EXECUTE THE AGREEMENT; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. G.A. Hermes and Mary E. Hermes are the owners of the building at 129 E. Hopkins <br />Street, the location ofthe Tap Room business downtown. The Hermes have requested permission <br />to use a portion of the alley at the rear of the building for maintenance of a deck/porch/stairway, and <br />maintenance of a portion of an existing building that encroaches into the alley. <br /> <br />2. The City is willing to grant permission for maintenance ofthe deck/porch/stairway and the <br />encroaching building in accordance with the terms of the attached License Agreement. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. The attached License Agreement between the City and G.A. Hermes and <br />Mary E.
