ORDINANCE N0.2008-50 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE <br />CITY TO ESTABLISH A PLANNED DEVELOPMENT DISTRICT OVERLAY <br />FOR 2.712 ACRE, MORE OR LESS, TRACT OF PROPERTY LOCATED AT <br />401 FREDERICKSBURG, 210-212 PAT GARRISON, 408 COMANCHE AND <br />418 COMANCHE WITH BASE ZONING OF MULTI-FAMILY <br />RESIDENTIAL; APPROVING DEVELOPMENT STANDARDS FOR THE <br />VINTAGE SAN MARCOS PDD; INCLUDING PROCEDURAL PROVISIONS; <br />AND PROVIDING FOR PENALTIES. <br />R F.f TTA T .C <br />1. On September 9, 2008, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to establish the zoning for the 2.712 acre, more <br />or less, tract of property located at 401 Fredericksburg, 210-212 Pat Garrison, 408 Comanche <br />and 418 Comanche, as a "PDD" Planned Development District, with base zoning of "Multi- <br />Family" to be known as the Vintage San Marcos Planned Development District. <br />3. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />did, on September 9, 2008, consider and vote to approve the request, and has recommended that <br />the request be approved by the City Council of the City of San Marcos. <br />4. The City Council held a public hearing on October 21, 2008, regarding the request. <br />5. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br />6. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Official Zoning Map of the City, as described in Section 4.1.2.2 of the <br />City Land Development Code, is amended to establish the zoning for the following tract of real <br />property (collectively, the "Project Site"), which are presently zoned as future development, as a <br />"PDD" Planned Development District, with base zoning as described below for the respective <br />tracts comprising the Project Site, subject to the provisions of the land use plan and development <br />standards described in Section 3 of this ordinance: <br />Street address: 401 Fredericksburg, 210-212 Pat Garrison, 408 Comanche and 418 <br />Comanche <br />Size: 2.712 acre, more or less.
