• ORDINANCE NO. 2008 43 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS TEXAS EXTENDING THE LOCAL STATE OF EMERGENCY <br />DECLARED BY THE MAYOR ON SEPTEMBER 10, 2008; DECLARING <br />A STATE OF DISASTER; PROVIDING FOR PENALTIES; PROVIDING <br />FOR SEVERANCE; PROVIDING FOR PUBLICATION; AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the Governor of the State of Texas on September 8, 2008, under the <br />authority of the Texas Disaster Act of 1975, proclaimed that Hurricane Ike, has created <br />an emergency disaster and emergency conditions for the people of the State of Texas, <br />and directed that all necessary measures, both public and private as authorized under <br />§418.015, Texas Government Code, be implemented to meet the disaster; <br />WHEREAS, the City of San Marcos has asked by the Governor to shelter refugees who <br />have been rendered homeless by Hurricane Ike and consequent flooding and <br />destruction of their homes along the eastern Texas Gulf Coast; <br />WHEREAS, on September 10, 2008, the Mayor issued a proclamation declaring a state <br />of emergency for the City of San Marcos resulting from the imminent danger as the <br />result of the unknown track for Hurricane Ike; which, at that time, was predicted to track <br />very close to the City of San Marcos; <br />• WHEREAS, Hurricane Ike came across the eastern portion of the Texas Gulf Coast <br />causing wide spread damage, flooding, loss of utilities, and destruction of homes; <br />WHEREAS, the City of San Marcos is under coordination with the Capital Area Shelter <br />Hub Plan to open an Intermediate Need Shelter; <br />WHEREAS, extraordinary measures are still needed to feed, house, and provide <br />medical and other essential support to those displaced by Hurricane Ike and the <br />flooding in Galveston and other Texas cities, and the City of San Marcos has <br />undertaken to house individuals dislocated by the hurricane damage; <br />WHEREAS, this public calamity continues to require continued emergency action; <br />WHEREAS, Section 26.007(c), Code of Ordinances, City of San Marcos, requires the <br />City Council to consent to the continuation of a local state of disaster declared by the <br />Mayor for a period in excess of seven (7) days; <br />WHEREAS, the City Council has determined that extraordinary measures must be <br />continued to alleviate the suffering of people and to protect or rehabilitate property; and <br />WHEREAS, the conditions necessitating declaration of a state of disaster continue to <br />exist; and <br />•
