ORDINANCE NO. 2010-39 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING CHAPTER 86, ARTICLE 3, <br />OF THE SAN MARCOS CITY CODE; ESTABLISHING <br />REGULATIONS GOVERNING THE USE OF GRAYWATER FOR <br />RESIDENTIAL, COMMERCIAL, INDUSTRIAL, AND <br />INSTITUTIONAL PURPOSES; ESTABLISHING PENALTIES <br />FOR THE VIOLATION THEREOF; PROVIDING FOR <br />PUBLICATION; AND PROVIDING AN EFFECTIVE DATE <br />RECITALS: <br />1. The City operates and maintains public water and wastewater systems for <br />the health, safety and welfare of its residents. <br />2. The City seeks to encourage conservation of water by establishing <br />minimum standards for the use of graywater for residential, commercial, industrial, and <br />institutional customers of the City's water and wastewater systems. <br />3. Providing for the regulated discharge and use of graywater will advance <br />such objective of the City and the City Council finds and determines that the adoption of <br />is this ordinance is in the interest of the health, safety and welfare of the public. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br />SECTION 1. Chapter 86, Utilities, Article 3, Sewers, of the San Marcos City <br />Code is hereby amended by adding Division 5, Graywater Systems, to read as follows: <br />DIVISION 5. GRAYWATER SYSTEMS <br />Sec. 86.166. General requirements. <br />(a) Gravwater is defined as wastewater from: <br />( 1) showers; <br />(2) bathtubs; <br />(3) hand washing lavatories; <br />(4) sinks not used for disposal of hazardous or toxic ingredients; <br />0 (5) sinks not used for food preparation or disposal; and <br />
