ORDINANCE NO. 2008-56 <br />• AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS AMENDING CHAPTER 2, <br />ADMINISTRATION, SECTION 2.569 OF THE SAN MARCOS <br />CITY CODE TO PERMIT THE CITY COUNCIL TO AWARD <br />BIDS FOR THE PURCHASE OF REAL PROPERTY, <br />PERSONAL PROPERTY THAT IS NOT AFFIXED TO REAL <br />PROPERTY, OR SERVICES TO BIDDERS WITH A PRINCIPAL <br />PLACE OF BUSINESS IN THE CITY IF THEIR BIDS ARE <br />WITHIN 5% OF THE LOWEST BID PRICE RECEIVED FROM <br />A NON-RESIDENT BIDDER; DECLARING AN EMERGENCY; <br />AND DECLARING AN EFFECTIVE DATE <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br />SECTION 1. The current Section 2.569. Local bidder preference of Article 7, Division 2. <br />Purchases and Contracts, is amended to read as follows: <br />ARTICLE 7. Finance <br />DIVISION 2. Purchases and Contracts. <br />• Sec. 2.569. Local bidder preference. <br />(a) In this section: <br />Local bidder means a bidder whose principal place of business is located within the city. <br />Nonresident bidder means a bidder whose principal place of business is not located within <br />the city. <br />(b) servo es ifltheacly receives orie o>pmore bidsofrom local lbiddersf and the bide property of <br />tlfee five percent of the lowest responsible bid received by the city from a nonresident <br />bidder, the city council may award the contract to the lowest responsible bidder who is a <br />local bidder, if the city council determines in writing that the local bidder offers the city <br />the best combination of contract price and additional economic development <br />opportunities for the city created by the contract award, including the employment of <br />local residents, and increased tax revenues to the city. <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held <br />to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />0
