• ORDINANCE '00.2008-57 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING THE RELEASE AND ABANDONMENT OF <br />A 20 FOOT PUBLIC UTILITY EASEMENT ACROSS A PORTION OF <br />PROPERTY LOCATED AT 309 LAZY LANE DRIVE; AND DECLARING AN <br />EFFECTIVE DATE <br />RECITALS: <br />1. The City is the owner of an interest in a public utility easement as recorded in <br />Volume 2, Pages 139-140 of the Official Plat Records of Hays County Texas that runs <br />along the western edge of Lot 1, Sleepy Hollow Subdivision with a street address of 309 <br />Lazy Lane Drive. <br />2. The owner of the property subject to this easement, Andrew and Holly Labay, <br />through their agent, Gracy Title Company, has requested the City to release the utility <br />easement. <br />3. The City staff has determined that this easement is not needed for current or <br />anticipated future needs of the Electric Utility Department or the Water/ Wastewater <br />Department. The other potentially interested public utilities have already released their <br />. respective interests in this easement. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The release and abandonment of the easement depicted on Exhibit 1, <br />and as described above in Recital One is approved. <br />SECTION 2. This Ordinance will take effect 10 days after the date of its final <br />passage. <br />PASSED AND APPROVED on first reading November 3, 2008. <br />PASSED AND APPROVED on second reading November 18, 2008. <br />PASSED, APPROVED AND ADOPTED on December 2, 2008. <br />Susan Narvaiz <br />Mayor <br />
