• RESOLUTION 2"408-165R <br />t <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN <br />INTERLOCAL AGREEMENT BETWEEN THE CITY OF SAN MARCOS, <br />AND HAYS COUNTY TO FACILITATE THE EXPENDITURE OF FUNDS <br />FROM A TEXAS PARKS AND WILDLIFE DEPARTMENT LAND AND <br />WATER CONSERVATION GRANT FOR THE SPRING LAKE PARK <br />PRESERVE; AUTHORIZING THE CITY MANAGER TO EXECUTE THIS <br />AGREEMENT ON BEHALF OF THE CITY; AND DECLARING AN <br />EFFECTIVE DATE. <br />RECITALS: <br />1. The City of San Marcos (the "City") and Hays County (the "County") have <br />negotiated an interlocal agreement to expend funds derived from a Texas Park and Wildlife Land <br />and Water Conservation Grant for the development of certain projects in Spring Lake Park. <br />These projects inlcude nature trails, a xeriscape demonstration garden, wildlife observation areas, <br />and other low impact park facilities. <br />2. This Texas Parks and Wildlife Department Land and Water Conservation Grant <br />was part of the funds applied for by the County as part of the County's contribution towards the <br />• purchase of the Park. <br />3. The attached Interlocal Agreement was approved by the Hays County <br />Commissioner's Court on November 18, 2008, and has been signed by the County Judge. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The terms and conditions of an Interlocal Agreement (the "Agreement") <br />between the City and the County for the expenditure of funds under a Texas Park and Wildlife <br />Grant to construct improvements to Spring Lake Park is approved. <br />PART 2. This Agreement is entered into pursuant to the Interlocal Cooperation Act, <br />Chapter 791 of the Texas Government Code, as amended. <br />PART 3. The City Manager, Rick Menchaca, is authorized to execute the <br />Agreement on behalf of the City. <br />PART 4. This Resolution shall be in full force and effect immediately from and <br />after its passage. <br />
