• RESOLUTION 2"408-165R t A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF SAN MARCOS, AND HAYS COUNTY TO FACILITATE THE EXPENDITURE OF FUNDS FROM A TEXAS PARKS AND WILDLIFE DEPARTMENT LAND AND WATER CONSERVATION GRANT FOR THE SPRING LAKE PARK PRESERVE; AUTHORIZING THE CITY MANAGER TO EXECUTE THIS AGREEMENT ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. The City of San Marcos (the "City") and Hays County (the "County") have negotiated an interlocal agreement to expend funds derived from a Texas Park and Wildlife Land and Water Conservation Grant for the development of certain projects in Spring Lake Park. These projects inlcude nature trails, a xeriscape demonstration garden, wildlife observation areas, and other low impact park facilities. 2. This Texas Parks and Wildlife Department Land and Water Conservation Grant was part of the funds applied for by the County as part of the County's contribution towards the • purchase of the Park. 3. The attached Interlocal Agreement was approved by the Hays County Commissioner's Court on November 18, 2008, and has been signed by the County Judge. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The terms and conditions of an Interlocal Agreement (the "Agreement") between the City and the County for the expenditure of funds under a Texas Park and Wildlife Grant to construct improvements to Spring Lake Park is approved. PART 2. This Agreement is entered into pursuant to the Interlocal Cooperation Act, Chapter 791 of the Texas Government Code, as amended. PART 3. The City Manager, Rick Menchaca, is authorized to execute the Agreement on behalf of the City. PART 4. This Resolution shall be in full force and effect immediately from and after its passage.
