PROFESSIONAL ENGINEERING SERVICES AGREEMENT <br />This Agreement is made and is effective as of this the 16th day of December, 2008, <br />between the City of San Marcos, Texas ("City"), 630 East Hopkins, San Marcos, Texas 78666 <br />and HDR Engineering, Inc. ("Engineer"), 4401 West Gate Blvd., Suite 400, Austin, TX 78745 <br />for the provision of preliminary engineering and feasibility studies in connection with the River <br />Road Union Pacific Railroad ("UPRR") Overpass Project and the Craddock Avenue Extension <br />Bridge Alternatives Study Project (the "Projects"). <br />The City and the Engineer agree as follows: <br />ARTICLE 1 <br />ENGINEER'S SERVICES AND RESPONSIBILITIES <br />1.0 STANDARDS OF PERFORMANCE <br />1.0.1 Engineer will be responsible for the provision of engineering services for each Project. <br />The Projects and services required are described as the: <br />a) River Road UPRR Overpass Project which consists of re-aligning River Road <br />between River Road and Aquarena Springs Drive in San Marcos. This Project <br />includes a new UPRR overpass to the west of the existing underpass and <br />approximately 1,800 feet of new location roadway with a 2-3 leg channelized "T" <br />intersection at River Road and Aquarena Springs Drive; and <br />b) Craddock Ave Extension Bridge Alternatives Study Protect which consists of <br />extending Craddock Avenue approximately two miles along new location roadway <br />from Ranch Road 12, north, to Lime Kiln Road. The Engineer will evaluate the <br />preferred alignment with input from the City and consideration given to the <br />development south of Lime Kiln Road which has recently been platted. The City has <br />already provided the Engineer with electronic files for the preliminary plat. Both the <br />Engineer and the city expect the preferred alignment to have a crossing at Sink Creek. <br />Additional water crossings may be required for the north/south tributaries of Sink <br />Creek if the alignment is shifted further to the west. The Engineer will assist the City <br />in defining the preferred alignment alternative, develop an opinion of cost to be used <br />during the CIP planning process and document the work in a schematic exhibit. <br />1.0.2 The Engineer's Basic Services consist of the services described in Sections 1.0 through 1.2 <br />and include normal civil engineering services. <br />1.0.3 The performance of all services by the Engineer in connection with this Agreement will <br />be by persons appropriately licensed or registered under State, local and Federal laws governing <br />their respective consulting disciplines.
