• <br />ORDINANCE NO. 2009-3 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS; INCREASING SURCHARGE RATES <br />FOR INDUSTRIAL WASTEWATER DISCHARGES UNDER <br />SECTION 86.132 OF THE CITY CODE; SETTING RATES FOR <br />WHOLESALE WATER TREATMENT, WHOLESALE WATER <br />SALES AND RECLAIMED WATER SALES; AND INCLUDING <br />PROCEDURAL PROVISIONS <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The wastewater (sewer) surcharge rates established under Section 86.132 of <br />the City Code are amended to read as shown on the attached Exhibit A, which is made a part of <br />this ordinance for all purposes. <br />SECTION 2. The Wholesale Water Treatment Rate for treatment of raw water at the <br />City's Surface Water Treatment Plant is increased from $1.46 to $1.53 per thousand gallons. <br />SECTION 3. The Wholesale Rate for water sold by the City of San Marcos is set at <br />minimum charge of $2.94 per thousand gallons. Additional charges will apply to recover the <br />City's costs to produce and deliver wholesale water including, but not limited to, point of <br />delivery charges, capital recovery charges, and metering charges. Such additional charges will be <br />set forth in contractual agreements approved by the City Council. <br />SECTION 4. The Reclaimed Water Rate is set at $1.27 per thousand gallons.I <br />• <br />SECTION 5. If any word, phrase, clause, sentence, or paragraph of this ordinance is <br />held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of <br />this ordinance will continue in force if they can be given effect without the invalid portion. <br />This rate represents a 5% increase above the initial contract rate with TXI, Inc. for reclaimed water.
