Section 1.5 Disposal of Recyclable Materials and Solid Waste <br />1.5.1 Disposal <br />The Contractor will haul and dispose of, or will arrange for the hauling and disposal of, all <br />recyclable materials and solid waste collected by it at a recyclable materials processing facility or <br />a solid waste disposal site licensed by the State of Texas for that purpose. The Contractor will <br />make every reasonable effort to dispose of recyclable materials at a recyclable materials <br />processing facility rather than at a solid waste disposal site. The processing facility and disposal <br />site will have adequate capacity to accommodate the requirements of this Contract. Any costs of <br />disposal, including without limitation, tipping, drop-off, processing or other fees charged for <br />processing or disposal are included in the fees set forth in this Contract. <br />1.5.2 Ownership of Collected Recyclable Materials <br />The Contractor accepts title to all recyclable materials placed in the Contractor's collection <br />vehicles, or received by the Contractor at the recycling center. The City does not accept <br />ownership or title to any such items. <br />1.5.3 Notifications and Disposal Site Reports <br />The Contractor will forward, to the City at its request, all copies of Texas Health Department <br />Inspection Reports for each recyclable materials processing facility and disposal site being used <br />for the disposal of recyclable materials collected under this Contract. <br />1.5.4 Interruption of Service <br />Notwithstanding any other provision of this Contract, if an interruption in the Contractor's <br />services continues for a period of ten days, the City will have the right to immediately terminate <br />this Contract and to seek any remedy provided by law. <br />ARTICLE 2 <br />THE CITY'S RESPONSIBILITIES <br />Section 2.1 <br />The City will designate Tom Taggart, Director of Public Services to act as the City's authorized <br />representative with respect to this Contract. <br />Section 2.2 <br />The City will assist the Contractor in encouraging customers and City employees to comply with <br />regulations by providing instruction, public service contact, and informational materials. <br />Page 5
