restricts future commercial and residential development of the Property ( "Conservation <br />Easement "). The terms and conditions cited in Articles I and V of this Agreement shall be <br />contingent upon the County's written approval of the above -cited Public Dedication and <br />Conservation Easement attached as Exhibit "D ". If the County, in its sole determination, <br />does not approve of the Public Dedications and Conservation Easement, then the City may <br />amend or supplement the Public Dedications and/or Conservation Easement to acquire the <br />written approval of the County. Any document submitted to County under this Section <br />shall be attached hereto as Exhibit "D ". Likewise, if the Parties supplement or amend any <br />document pursuant to this Section, the most recent documentation that evidences the <br />requirements cited above shall be attached hereto as Exhibit "D," and any obsolete <br />documentation shall be removed from Exhibit "D." <br />VII. Amendments. <br />7.1 This Agreement can be amended only by written approval of the Hays County <br />Commissioners Court and the San Marcos City Council. <br />VIII. Authorization to Sign. <br />8.1 Elizabeth "Liz" Sumter, Hays County Judge, is authorized to sign this Agreement on behalf <br />of Hays County, Texas. Rick Menchaca, City Manager, is authorized to sign this <br />Agreement on behalf of the City of San Marcos, Texas. <br />IX. Representations. <br />9.1 City and County each make the following representations to each other as inducements to <br />enter into this Agreement: <br />a. That it has the legal authority to enter into this Agreement for the purposes stated <br />herein and to perform the obligations it has undertaken hereunder; <br />
