RESOLUTION NO. 2009-12R <br />• A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AUTHORIZING THE CITY MANAGER TO <br />NEGOTIATE AN INTERLOCAL AGREEMENT WITH HAYS <br />COUNTY TO ACCEPT THE TRANSFER OR LEASE OF <br />APPROXIMATELY 1,200 SQUARE FEET OF PROPERTY <br />LOCATED AT THE INTERSECTION OF LBJ AND MLK <br />STREETS TO INCLUDE RESPONSIBILITIES FOR THE <br />DESIGN, CONSTRUCTION AND MAINTENANCE OF A <br />MEMORIAL TO BE ERECTED ON THE PROPERTY; AND <br />SETTING AN EFFECTIVE DATE. <br />WHEREAS from its earliest days former President Lyndon Baines Johnson and Martin <br />Luther King were significant contributors to the Civil Rights Movement; <br />WHEREAS Lyndon Baines Johnson graduated from Southwest Texas State Teachers <br />College (now Texas State University - San Marcos) in 1930; <br />WHEREAS San Marcos is the only city in the State of Texas where there is an existing <br />intersection of streets named after Lyndon Baines Johnson and Martin Luther King; <br />WHEREAS given the connection to San Marcos, the unique setting where LBJ and MLK <br />• streets intersect, and the contributions made by Lyndon Baines Johnson and Martin <br />Luther King the installation of a memorial celebrating the two civil rights leaders would <br />be appropriate; <br />WHEREAS more than twelve years ago community leaders placed a temporary marker <br />at the corner of LBJ and MLK Streets; and, <br />WHEREAS the City Council of the City of San Marcos Texas finds that the corner of <br />LBJ and MLK Streets is an appropriate place to erect a permanent memorial to these <br />remarkable men. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS : <br />PART 1. The city manager, Rick Menchaca, is authorized to negotiate and <br />enter into an interlocal agreement with Hays County for the purpose of accepting the <br />transfer of lease of land located at the intersection of LBJ and MLK Streets. The city <br />manager is further authorized to include within this interlocal agreement responsibilities <br />for the design, construction and maintenance of a memorial honoring Lyndon Baines <br />Johnson and Martin Luther King. <br />0 PART 2. This Resolution is effective on and from the date of its passage.
