INTERLOCAL AGREEMENT FOR THE PURCHASE AND SALE OF REAL PROPERTY <br />THIS INTERLOCAL AGREEMENT FOR THE PURCHASE AND SALE OF REAL <br />PROPERTY (hereinafter "ILA") is hereby made by and between Hays County, a political <br />subdivision of the State of Texas (hereinafter "the County") and the City of San Marcos, <br />Texas (hereinafter "the City"). The County and the City are hereinafter collectively <br />referred to as "the Parties." <br />ARTICLE I: Recitals. <br />WHEREAS, Hays County, Texas and the City of San Marcos, Texas both possess a rich <br />history that warrants commemoration; <br />WHEREAS, the Parties recognize the public benefit of historic monuments in <br />establishing a sense of place and local pride; <br />WHEREAS, Lyndon Baines Johnson and Martin Luther King, Jr. were collaborators and <br />significant contributors to the Civil Rights movement in the United States of America; <br />WHEREAS, Lyndon Baines Johnson had personal ties to Central Texas and the City of <br />San Marcos, Texas, where he attended Southwest Texas State Teachers College in 1930; <br />WHEREAS, the City of San Marcos, Texas is the only city in the State of Texas (and <br />perhaps in the United States) that features an intersection of streets named after Lyndon <br />Baines Johnson and Martin Luther King, Jr.; <br />WHEREAS, the community has long thought that the intersection of LBJ and MLK <br />Streets in San Marcos, Texas would be a fitting location for a memorial honoring the <br />collaboration between Lyndon Baines Johnson and Martin Luther King, Jr.; <br />WHEREAS, the City Council of San Marcos, Texas has found that the Southwest corner <br />of the intersection of LBJ and MLK Streets is an appropriate place to erect a permanent <br />memorial honoring the collaboration between Lyndon Baines Johnson and Martin Luther <br />King, Jr. (See depiction in Exhibit "A") (hereinafter "the Property"); <br />WHEREAS, the County currently owns, in fee simple, the real property that includes the <br />Southwest corner of LBJ and MLK Streets; and <br />WHEREAS, the County wishes to support and facilitate the City's plan to erect a <br />permanent memorial honoring the collaboration between Lyndon Baines Johnson and <br />Martin Luther King, Jr. by conveying the real property on the Southwest corner of LBJ <br />and MLK streets to the City; <br />NOW THEREFORE, the Parties hereby agree as follows: <br />LBJ/MLK- ILA/PSA
