50. ORDINANCE 2002- 5 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 0.157 ACRE TRACT OF PROPERTY LOCATED AT THE CORNER OF CENTRE STREET AND SHADY LANE FROM "M" SINGLE-FAMILY, DUPLEX AND NEIGHBORHOOD BUSINESS DISTRICT TO "R-2" SINGLE-FAMIL Y DWELLING DISTRICT (MEDIUM DENSITY); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENAL TIES. RECITALS: 1. On November 13, 2001, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the zoning from "M" Single-Family, Duplex and Neighborhood Business District to "R-2" Single-Family Dwelling District (Medium Density) for a 0.157 acre tract of property located at the comer of Centre Street and Shady Lane. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on November 13, 2001 consider and vote to approve the request, and has recommended that the request be approved by the City Council of the City. 3. The City Council held a public hearing on the ? R t: 11 ,January ,2002, regarding the request. day of 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to zoning map amendments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code, is amended to rezone the following real property which is presently zoned "M" Single-Family, Duplex and Neighborhood Business District to "R-2" Single-Family District (Medium Density): Street address: Comer of Centre Street and Shady Lane. Size: 0.157 acres.
