INTERLOCAL AGREEMENT BETWEEN <br />HAYS COUNTY, CITY OF SAN MARCOS, AND TEXAS STATE UNIVERSITY -SAN MARCOS <br />REGARDING DEVELOPMENT OF AN UPPER SAN MARCOS WATERSHED PROTECTION PLAN <br />THIS AGREEMENT, entered into by Texas State University -San Marcos (Texas State), the City of <br />San Marcos (City), and Hays County (County), builds on the MEMORANDUM OF UNDERSTANDING <br />(MOU) signed in January 2010 by these same entities to develop a watershed protection plan for the <br />Upper San Marcos Watershed. <br />WHEREAS, the Upper San Marcos Watershed is comprised of the Sink Creek, Sessom Creek, <br />Purgatory Creek, and Willow Creek Watersheds as indicated in the above- referenced MOU. <br />WHEREAS, Texas State, the City and County began meeting informally in June 2009 to discuss <br />and develop an effective organizing framework to enhance cooperation and coordination among various <br />environmental programs and activities within the Upper San Marcos watershed. <br />WHEREAS, in January 2010 the parties hereto formalized their intentions by signing a MOU to <br />coordinate current watershed protection efforts and identify steps toward developing an Upper San <br />Marcos Watershed Protection Plan (USMWPP). <br />NOW THEREFORE, Texas State, the City, and County hereby mutually agree to proceed as <br />follows: <br />1. Coordination and Cooperation. Under this agreement the River Systems Institute at Texas <br />State will coordinate activities as follows: <br />• Convene regular meetings between representatives of the three parties and <br />representatives of other watershed related programs in order to enhance <br />communications and coordination; <br />• Develop a watershed protection plan framework following United States Environmental <br />Protection Agency Guidelines; <br />• Pursue grants and other resources to support a formal watershed protection planning <br />effort that will include a public stakeholder process. <br />2. Understanding. It is the intention of the participating parties that the USMWPP will <br />accomplish the following: <br />■ Identify shared goals and plans; <br />■ Enhance communication and coordination among existing water resource programs; <br />• Emphasize programs and strategies that address water quality, pollution prevention, <br />storm water management, and endangered species protection; <br />• Develop and implement a unified approach to research, education, watershed <br />stewardship and service programs throughout the Upper San Marcos Watershed; <br />• Pool resources and capabilities to leverage external funding. <br />1 <br />I NTERLOCAL AGREEMENT-USMWPP <br />
