<br />232. <br /> <br />ORDINANCE NO. 2003 _ .65 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS APPROVING THE CONVEYANCE <br />OF A 14,400 SQUARE FOOT TRACT OF REAL PROPERTY <br />LOCATED OFF OF VALLEY VIEW WEST ROAD TO THE <br />UNITED STATES FEDERAL AVIATION ADMINISTRATION; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE A <br />SPECIAL WARRANTY DEED; AND PROVIDING AN <br />EFFECTIVE DATE. <br /> <br />0 tm <br />~O (I) <br />o- m <br />;;~ "'V <br />CD (') c:= ~r- <br />:J r -:. ~m <br />Ej] '-.~ F8 <br />2::) <br />0" 0 <br />0 v..> ~ <br />. <br /> <br />RECITALS: <br /> <br />1. The City is the owner of a 14,400 square foot tract of real property (the "Outer <br />Marker Site") located in the F.W. Stovall Survey No.1 off of Valley View West Road, upon <br />which the United States Federal Aviation Administration ("FAA") maintatns and operates <br />a radio transmitter station associated with the instrument landing system for the San <br />Marcos Municipal Airport. <br /> <br />2. A staff analysis has been made that has determined that since the Oouter <br />Marker Site is only large enough to house the outer marker equipment owned by the FAA, <br />there is no present or anticipated future need for the City to retain this property. <br /> <br />3. The City Council finds and determines that the value to the City of the FAA <br />undertaking ongoing maintenance responsibility for the Outer Marker Site, and continuing <br />operation of the equipment at the site, equals or exceeds the fair market value of the Outer <br />Marker Site, and the City Council is therefore willing to convey the Outer Marker Site to the <br />FAA without cash consideration. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The conveyance of the Outer Marker Site from the City to the FAA is <br />approved. <br /> <br />SECTION 2. The City Manager, Dan O'Leary, is authorized to execute the attached <br />Contract to Sell Real Property for the Outer Marker Site, and to execute all other <br />appropriate documentation, including a special warranty deed, to complete this <br />conveyance. <br /> <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance <br />is held to be unconstitutional or invalid by a court of competent jurisdiction, the other <br />provisions of this ordinance will continue in full force if they can be given effect without the <br />invalid portion. <br />
