<br />The undersigned, hereinafter called the "Vendor," who represents that he (she) (it) is the owner of the real property described below, hereby, for
<br />himself (herself) (itself), his (her) heirs, executors, administrators (its), successorsandassigns, agrees to convey to the United States of America, in
<br />accordance with the terms and conditions set forth herein, the land, together with the buildings and improvements thereon, unless specifically
<br />excepted, and all rights, hereditaments, easements, and appurtenances thereto.

<br />The real property which the Vendor agrees to convev to the United States of America is located in:

<br />as shown by the attached plat and more. particularly described as follows:
<br />A parcel ofland containing 14,400 square feet out of the F. M. Stovall SurveyN<;>;,J., Hays County, Texas, and lying wholly within that 307.12 acre tract
<br />conveyed by FIrst Investors Leasing COrPoration to Emmett F. McCoy by.that <leed dated,.8 March 1974, filed on 11 March 1974, and recorded on 12 March
<br />1974 in the deed records of said county. This 14,400 square foot parcel is shoWn on a plat ofa survey of said parcel by Charles R. Swart, Surveyor, dated 3
<br />September 1982, identified as Exhibit "A" attached hereto and made.a part hereof; 'and is described by metes and bounds as follows:
<br />Beginning at the west comer of the 14,400 square foot parcel, which is marked with an aluminum capped steel rod monument on the southeast line of a
<br />fifty foot wide private road, from this west corner an iron pipe marking the east cotner of Lot 90fValley View West, an unrecorded subdivision, bears
<br />N44059'00"Wa distance of 50.0 feet, and thence N45001 'OO"E a distance of 760.28 feet. From this west comer an iron pipe marking the point of curvature
<br />on the southeast line of Lot 8 ofsaid subdivision bears N44059'00"W a distance of 50.0 feet, 3lld thence S45001'00"W a distance of 309.71 feet. Thence
<br />from the Point of Beginning N45001 'oo"E along the southeast line of the private road a distance of 120.0 feet to the north corner of the 14,400 square foot
<br />parcel, from which an aluminum capped steel rod witness cpmer bears S450Ol'00"W a distance of 2.00 feet; THENCE, from the north corner of this parcel,
<br />S44059'00"E a distance of 120.0 feet to the east corner of this parcel from :which an ~uminum. capped steel rod witness corner bears S45001 'OO"W a
<br />distance of 2.0 feet; thence from the east comer of this parcel, S45001 'OO"W a distance of 120,0 feet to the south corner of this parcel, which is marked with
<br />an aluminum capped steel rod monument; thence, from the south corner of this parcel N44 059'00"W a distance of 120.0 feet to the Point of Beginning, and
<br />containing 14,400 square feet.
<br />The Vendor and agrees to convey to the United States of Americ~ the iridefe~ibl~ fee simple title to the above-described land subject only to the

<br />The fee simple title to the land described subject, however, to existin.g, eas<;m~l).tsJor public roads and highways, public utilities, railroads, and
<br />pipelines; excepting and excluding from the taking all oil and gas in and under saidlarid and all appurtenant rights from the exploration, development, and
<br />removal of said oil and gas but without the, right to enter upon or over the surface of said land for the pwpose of drilling and extracting therefrom said oil and
<br />gas; provided, however, that the said gas, and appurtenant rights so eXl;epted and excluded are.~ubordinated to the prior right of the United States to utilize
<br />the land in connection with the operation and maintenance of the OM,facility.
<br />The Vendor, and the spouse, if any, of the Vendor, by signing below; agrees to join in any deed to the United States, and agrees to convey said real
<br />property to the United States of America in consideration of the sum of Zero Dollars ($0) which amount shall be paid at the time the
<br />~ title to the property become vested in the United States.
<br />The Vendor further agrees that the United State shall have ~ days to indicate its acceptance of the contract price and the terms and conditions
<br />herein, by mailing or delivering a copy of this contract signed by a duly, authorized representative of the United States, to the Vendor at the address
<br />indicated below.
