shall specify all applicable deviations from the adopted Land Development Code. Thereafter, development <br />applications shall be consistent with the specific project described in the Development Incentive Agreement <br />and shall be processed in accordance with the provisions of the Land Development Code as waived or <br />• modified by the agreement. <br />Section 1.4.4.4 Expiration, Extension, Amendment and Termination of Agreement <br />(a) Expiration. The waivers or modifications of development standards contained in the agreement shall <br />apply to anv required applications for development of the specific project that are approved and accepted <br />during the term of the agreement. <br />(b) Amendment. The Development Incentive Agreement may be amended from time to time under the <br />procedure for approval of an original application requesting a development incentive. <br />(c) Termination. The Development Incentive Agreement may be terminated for breach of the agreement <br />or other reasons in accordance with its terms. If the Development Incentive Agreement expires or is <br />terminated before anv and all required development applications have been made and accepted, the <br />development standards shall be those specified in the current Land Development Codes. <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or <br />invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can <br />0e given effect without the invalid portion. <br />SECTION 4. All ordinances and resolution or parts of ordinances or resolutions in conflict with this ordinance are <br />repealed. <br />SECTION 5. The importance of this Ordinance creates an emergency and an imperative public necessity, and the <br />provisions of the Charter requiring that ordinances be presented at three separate meetings, and that ordinances do <br />not take effect until ten days after the date of its final passage are suspended, and this Ordinance will take effect at <br />12:00 a.m. on the day following the date of publication of notice of its adoption in a newspaper of general <br />circulation within the City. <br />PASSED, APPROVED AND ADOPTED this 6th day of October, 2008. <br />Susan Narvaiz <br />Mayor <br />ATTEST: APPROVED- <br />Le rry Mash Mic ael J.
