ORDINANCE NO. 2010- 4 5 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AN AMENDMENT TO THE <br />FUTURE LAND USE MAP FROM "I" INDUSTRIAL TO "MDR" <br />MEDIUM DENSITY RESIDENTIAL FOR A 5.85 ACRE, MORE OR <br />LESS, TRACT OF LAND OUT OF THE J.M. VERAMENDI SURVEY <br />NO.2, ABSTRACT NO. 17, LOCATED AT THE SOUTHEAST <br />CORNER OF BRIAR MEADOW ROAD AND THE MISSOURI <br />PACIFIC RAILROAD; AMENDING THE OFFICIAL ZONING MAP <br />OF THE CITY BY REZONING THIS TRACT FROM "LI" LIGHT <br />INDUSTRIAL DISTRICT TO "MF -12" MULTIPLE - FAMILY <br />RESIDENTIAL DISTRICT; AND INCLUDING PROCEDURAL <br />PROVISIONS <br />RECITALS: <br />1. On July 13, 2010, the Planning and Zoning Commission of the City of San Marcos <br />held a public hearing regarding a request to change the Future Land Use Map of the San Marcos <br />Horizons City Master Plan from "I" Industrial to "MDR" Medium Density Residential, and a <br />concurrent request to change the zoning from "LI" Light Industrial District to "NW-12" Multiple - <br />Family Residential District, for a 5.85 acre, more or less, tract of land located at the southeast <br />corner of Briar Meadow Road and the Missouri Pacific Railroad. <br />2. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />considered and voted to approve the requests on July 13, 2010, and recommended that the <br />requests be approved by the City Council of the City. <br />3. The City Council held a public hearing on August 17, 2010 regarding the requests. <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Future Land Use Plan of the San Marcos Horizons City Master Plan is <br />revised to change the future land use designation for the following real property from "I" <br />Industrial to "MDR" Medium Density Residential: <br />Street address: Southeast corner of Briar Meadow Road and the Missouri Pacific <br />Railroad <br />
